I was assaulted by 3 secuity guards from B&Q - now on RLP database?

 To cut a long story short I was assaulted by 3 secuity guards from B&Q and dragged back into the store passed all the tills and falsely imprisoned in an office at the front of the store.

 

As a result of the assault an ambulance was called.

I am currently on sick leave which is a huge problem as I run my own company.

 

When the police arrived they took my name and questioned me.

When I produced my receipt that was the end of the matter.

As far as the police are concerned.

I was free to go.

 

However, the security guards overheard the police questioning me and obtained my name address and date of birth.

Regardless of the fact that the police stated my actions were not dishonest they proceeded to ban me from every store in the country.

They also issued me with a notice of intended civil recovery, for the sum of £250.

 

The police have said that they have had no losses.

 

Having researched RLP I started to become very concerned and Contacted the Information Commisssioners Office.

I was instructed by the Information Commissioners Office to request that my name and details are removed from any databases that they operate or any databases that they supply data for especially RLP and Cerico databases.

To make one point clear I was challenged outside the store by 3 unidentified males. When one of them started to push me I warned him that it was assault and when he did it again I called the police. I am not a thief. The security guards wrestled my replacement bolier off me. When I started walking back to the store the 3 secuirty guards jumped me. One had his arm around my neck and the others had my arms. At this point B&Q were in possession of my money the faulty bolier and my repalcement bolier. I am taking action against B&Q for assault and false imprisonment. The security guards are facing criminal proceedings.

I have had no correspondence from RLP yet. The Notice of intended civil recovery was handed to me in the office that I was imprisoned in at the B&Q store. I told the B&Q manager that I would be holding B&Q responsible. The Notice refers to the passing of my data to an RLP database. The one example given of the use of my data contained on the RLP database would be to check application forms but it does not define the nature or type of the appliaction form.

 

This is the notice.

 

NOTICE OF CIVIL RECOVERY

 

You have been detained in: ...B&Q Ashton Under Lyne Store upon reasonable belief that you have acquired property or cash or by your wrongful actions caused loss to this company to the value of

 

£250

 

This notice informs you that we will seek compensation from you by civil recovery for the financial losses we have suffered from your wrongful act.

These losses may include but are not limited to:-

 

The value of the property or cash

The cost to restore the goods for sale if recovered and not damaged

The cost of your detention

The costs of the investigation in to the offence

A proportion of security costs, surveillance and loss prevention measures at the store to prevent such thefts

 

CIVIL RECOVERY IS NOT A FINE AND IS ENTIRELY SEPERATE FROM ANY CRIMINAL PROCEEDINGS THAT MAY BE TAKEN AGAINST YOU BY THEPROSECUTING AUTHORITIES.

What have B&Q had to say about things ?

The whole incident both inside outside the store was captured on CCTV. B&Q have assured me that they have secured the copies of the CCTV. I have made a written formal request for disclosure of the CCTV. I spoke to the Police Officer on Friday and he confirms that the security guard was behind me with his arm around my neck, whilst the other was holding my arm.

 

B&Q's risk management team are investigating the incident.

I note that B&Q have a history of assaulting there customers. Exactly a year ago they attacked another of there customers. The only difference between his assault and mine was that I had actually returned the goods that I had paid for and was leaving with replacement combination bolier for which I paid £500.

Last wednesday I was surrounded by 3 security whilst leaving B&Q with goods that I had a receipt for. They started pushing me and I said that if they touched me again I would call the police. They pushed me again and I telephoned 999. I was assaulted and dragged back into to the store. The police arrived and questioned me. When I produced the receipt for the £500 combi bolier that was the end of the matter as far as the police were concerned. As a result of the imjuries I sustained in the assualt an ambulance was called and I spent the afternoonat hospital.

 

I have been banned from every B&Q store in the country and they issued me with a notice of civil recovery. The assualt was captured on CCTV. The security guards are now facing criminal proceedings and I am awaiting a response from the B&Q risk management team as to what they intend to do about the about assault and false arrest.

 

It is exactly a year since B&Q security guards assaulted another customer Tiler1. I was just wondering if I was assaulted because they hadn't met there quota of assaults on customer for this year.

 

I have been a loyal customer of B&Q for many years. In the course of my business I spend approximately £10,000 a year at B&Q. B&Q are refusing to remove my name from a database of dishonest people. This is in the full knowledge that the police have investigated the incident and reached the conclusion that my actions were that of an honest person. I have been instructed by the ICO to request that B&Q remove my details immediately from the database.

 

I am now on sick leave and I intend to hold B&Q responsible for the injuries caused to myself and for loss of earnings. My only concern is that the CCTV evidence will disappear. I would be interested to know of similar incidents at B&Q.

I have a question for you.

 

I am now on a database of dishonest people even though I did not steal anything, I exchanged a faulty boiler for a new one. At the time of the assault by the security guards B&Q had in their possession my faulty boiler(inside the store at the returns counter). They wrestled the replacement boiler off me and for good measure they also had my £500. I am not dishonest the police took no action against me. However, B&Q have claimed I am dishonest in the full knowledge that the incident was investigated by the Police and they reached the conclusion that there was no dishonesty on my part. It is possible that B&Q have over stepped the mark and created a false instrument?

 

For the purposes of offences involving false instruments the word 'instrument' is defined as :

 

section (d) any disc, tape, sound track or other device on or in which imformation is recorded or stored by mechanical , electronic or other means. A database record in a computers electronic memory meets this definition of an instrumnent.

 

A deliberate false entry on a database stating that someone is dishonest in the full knowledge that a Police investigation states that they are not meets the definition of making a false instrument?

Hi Cjaynap,

 

Did you sign any paperwork whilst you were there? It seems from reading other posts that this is how RLP get your 'permission' to process your data, you agree to it when you sign the form. If you didn't then you didn't agree to anything.

Often the detained person will sign the forms under duress,and are under the impression that it is a legal requirement because the process is not explained to them.

Did you sign any paperwork whilst you were there? It seems from reading other posts that this is how RLP get your 'permission' to process your data, you agree to it when you sign the form. If you didn't then you didn't agree to anything.

I was asked to sign a document agreeing to be banned from every B&Q store in the UK I refused. I was never asked to sign any document from RLP.

No they did not obtain my permission. I specifically asked the security guard to leave the room whilst I was been interviewed by the police but he refused.

The police officer boobed big time. He should have demanded that the security guard leave the room as soon as you requested he do so

 

The guard was a witness & should never have been allowed to be present during interview. Either we ain't training coppers properly or this one was an idiot

 

Methinks the copper or coppers may be worth interviewing. It used to cost £60 & took place under the watchful eye of a senior officer. If now't else the word will spread that they better act within the rules or face civil action
