    • it was a windscreen ticket - thank you.   pop up on the MCOL website detailed on the claimform. .  register as an individual  note the long gateway number given  then log in .  select respond to a claim and select the start AOS box. .  then using the details required from the claimform .  defend all  leave jurisdiction unticked.  click thru to the end  confirm and exit MCOL. .  get a CPR 31:14 request running to the solicitors [if one is not listed send to the claimant] no need to sign anything . you DO NOT await the return of paperwork. you MUST file a defence regardless by day 33 from the date on the claimform [1 in the count]
    • I no longer have the original ticket        The location is Royal Wharf E16
    • we'll need the location from the poc please.   if you still have things like the original ticket notice to keeper/driver   we will need those scanned bothsides to one multipage pdf read upload
    • I've entered details online, defended, does this look OK?    TIA
    • Hello, we bought a motorhome from Marquis in Preston, collected it on 8 August. Went to stay in Southport with it for a few days, left on Sunday 11 August to return home to Scotland. Motorhome drove perfectly from Southport to Dumbarton where we stopped at Service Station. When we came back to motorhome it wouldn't start. Tried several times to turn it over but just wouldn't start. Phoned the AA who came out. When they tried it, it started!! The AA man connected it to his device and said that there was 5 issues logged. The main one was an immobilizer fault. The other 4 were to due with fuel and oil levels and pressure but they were a result of the immobilizer fault. He cleared the fault and we drove home. On notifying Marquis of the problem they said nothing to do with them, to book it in to Peugeot. Tried to book with Peugeot but they won't take it as not currently broken down. Said we would have to wait until it breaks down again, not to let AA clear fault and have it recovered to nearest garage. Motorhome is brand new, 2019 ELDDIS Majestic with 800ish miles. We are unhappy that it doesn't seem reliable as shouldn't have a fault with immobilizer when new. Intimated to Marquis that reject motorhome under 30 day period of Consumer Rights Act. They have written to say they dont accept rejection as there is no longer a fault, therefore no grounds to reject and ask for refund. Motorhome was £48500 and would have thought shouldn't break down on its first outing. From other threads Marquis appear to be difficult to deal with, but do we legally have rights or do we have to just accept what they have said? Any advice would be very much appreciated, never been in a circumstance such as this before and dont know what to do. We live in a remote area in Scotland and have a 9 year old who will be with us on our motorhome travels, so a reliable vehicle is essential. Thanks in advance for any help.

After asking halifax to cancel the CPA theyve basically told me they can't do it, so I've asked to 'escalate' the issue and also will be writing a letter.

I wonder why their support agent didnt seem to think so... I asked them to escalate my issue so we will see.. maybe its because I couldnt provide a specific transaction/transaction date? Anyway I am sending a letter so hopefully that will work.

This is what I am writing:

Dear Sirs,

Account no: XXXXXXXX

Card no: XXXX XXXX XXXX XXXX

Please act upon the following instruction with immediate effect:

I withdraw my authority for all future payments to be debited from the above account/card number by PayPal, including continuous payment authorities (the Payment Services Regulations 2009 apply).

FCA regulation states that “you do have the right to cancel directly with your card issuer. Once you have done this, it must stop payments immediately – it cannot insist that you agree this with the company taking the payment first.”

Please confirm in writing that you have received and actioned this instruction.

Yours faithfully,

XXX XXX

Ok so after chatting with Halifax again they have said that:

'as the link to my paypal account is for purchases made, this is not an instance of a recurring transaction as each of the transactions are processed on an individual basis with a unique reference for each purchase'.

Does this mean I don't have a CPA with paypal?

I would simply now write and state they are not to honour any payments demands in whatever format to Paypal or ebay from the date of this letter.

ok, this is the updated letter that I wrote and sent today:

Quote

6/25/2019

Dear Sirs,

Account no: XXXXXXXX

Card no: XXXXXXXXXXXXXXXX

Please act upon the following instruction with immediate effect:

I withdraw my authority for and request that you do not honour any and all future payments and payment demands to be debited from the above account/card number by PayPal and/or Ebay, including continuous payment authorities (the Payment Services Regulations 2009 apply) following the date of this letter.

FCA regulation states that “you do have the right to cancel directly with your card issuer. Once you have done this, it must stop payments immediately – it cannot insist that you agree this with the company taking the payment first.”

Any charge or attempt at charging me from either of these companies is unauthorized.

Please confirm in writing that you have received and actioned this instruction. By the time you receive this letter I will have moved address, so for any correspondence please check and confirm the current address held in the system for my account, as it will have changed from what it is today.

Yours faithfully,

XXXX XXXX

Seeing as my bank specifically told me that I DONT have a CPA with paypal, does this mean that cancelling my card would effectively stop them from charging me via it? as my direct debit is already cancelled, my card details are the only thing they still have, and if there is no CPA I assume that means they can't charge me if the card is now replaced.

Is there anything else I should do at this point?

I wouldn't trust the phone operator to know what they are talking about, many are untrained and simply follow on screen scripts.

the 1st sentence of your letter is somewhat confusing.

KISS

You are hereby instructed not to honour any payments demands in whatever format to Paypal or ebay from the date of this letter.

I just tried to report this to ebay and they said to tell local police, and theres nothing they can do.

was this the outcome you would expect?

i honestly feel its very unlikely the police will be able to actually help..

read some scary stories about debt collectors contacting family members, is this likely to happen to me?

so what!!

not for ebay crap

stop reading rubbish and wise up.

a dca is not a bailiff and has zero legal powers on any debt.

as for ebay

what did you expect.

they don't care.

WRITE a letter to the registered UK HQ

forget about it all.

Ok, one more thing - does the fact I opened the paypal when I was under 18 (although obviously older now) mean I might not be liable for any of it? or is that irrelevant?
