    • very telling comment by the PE   However, please be advised that this did not meet the discretionary criteria set by the landowner in this case   that the criteria for parking is set by the landowner...i bet they have no contract with them but a managing agent..and i bet there is no criteria at all listed in it.   dx
    • Hi Thanks in advance for the assistance provided in these forums it is invaluable.   We received a Parking notice after my wife was dropping me off to pick up a hire car, and she got out to get a bottle of water then left the area as we couldn't find the office. Having dealt with a Private Parking Company through my work as an FM i know they will try to bully you into paying but want to make sure i follow the process correctly.   1 Date of the infringement 01/09/2020     2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 07/09/2020     3 Date received 18/09/2020   4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [Y/N?] Yes   5 Is there any photographic evidence of the event? Just a picture of the car front and number plate    6 Have you appealed? [Y/N?] post up your appeal] No   Have you had a response? [Y/N?] post it up No   7 Who is the parking company? UKCPS   8. Where exactly [carpark name and town] Gateway House Picadilly   For either option, does it say which appeals body they operate under.       I bought some clothes online in may through Evans and paid through PayPal
      returned them all seven days later
       
      I waited the 14days for my refund and no refund came
      I put in a dispute through PayPal but I didn’t get any emails to escalate the case - PayPal closed it. 
      evans said they couldn’t refund the money because PayPal have cancelled the refund because of the open dispute
       
      I contacted PayPal
      they said the dispute had been closed but Evans at no point had attempted a refund.
      fast forward to today
       
      I’ve got copies of numerous messages sent to and from twitter messages as it’s the only way I can contact them
      I’ve also contacted their customer service too
      all I get is PayPal have cancelled refund because dispute is still open.
       
      I have proved that the dispute is closed
      I have got an email saying that if Evans sent the refund they would accept it
      but up until the date I got the email they have not once attempted a refund .
       
       I have sent them a letter before court email
      I have even offered to have the full refund as a gift card just to get this sorted !
       
      I’m literally at the end of my tether and don’t know where to turn next !
       
      i suffer with mental health issues and this is affecting my health and I’d saved the money for a year to buy these clothes as I’m on a low income .

I opened an account at CCF part of travis Perkins in 07,

my company went bust a year later,

CCF then pointed out I had a directors guarantee.

I subsequently entered into an Iva with debt free direct so I didn’t lose my house.

 

After completing the Iva with little problems and now 11 yrs on look to sell my house I have since found out TP have a charging order on my property.

They stated they declined to enter into the Iva.

I was not told about this and they have not contacted me for any payment in 11 years so was a little shocked to find this out now, they want £3100 to lift the charging order. Any advice would be appreciated.

Cant get a charging order without first getting a CCJ (judgment)...did you never receive a court claim ?

 

Was you aware you had a CCJ ?

I honestly don’t think I had a ccj it just seemed so quick after the company closed that they put a charging order on. The house is jointly Owned but the debt is in my name as I was director.

then surely it a restriction k?

have you got the text from the deeds/land registry.

 

bottom line is if it is a restriction k 

there stuff all you need to do other than inform them the home is sold, if that's why you are having issues here.?
