so I have just received my single justice procedure notice through the post last night. It has the witness statement attached with case number. however no person in charge of my case details/name on it. 

any advice of my next step please?  call / continue writing to TFL ?

Hi HB, 

 

I can't see any court dates? there is a charge date. is it 21 days from that? I know I have to either plea guilty or not within 21 days.

do you think there is any chance for a OOC settlement ? is it best to write again or call first to find out who has been assigned to my case then write to that person specifically ?

You can’t “plead guilty and attend” for a SJP case.

under the Single Justice Procedure a single magistrate hears the case “on the papers”.

If you wish to attend you have to say you wish for a hearing, rather than the SJP.

 

The hazard to that is that the SJP is intended to free up the bench’s time, and any benefit from attending can be exceeded by them feeling that the case could have been heard under SJP and wasn’t, taking up the court’s time unnecessarily.

 

You won’t get to “see a prosecutor on the day” with the SJP either. In order to see a prosecutor on the day and negotiate with them you’d have to plead not guilty. Pleading guilty they have no incentive to settle OOC.

Pleading not guilty? It is a massive risk, as if they don’t settle out of court they have you “bang to rights”
