      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi guys, I have bought the phone Samsung A50 from Argos but I am not able to get any cashback as on the Argos website advertised

Just was wondering if is not a misleading advert or any [problem]? Sorry to ask you but I spent nearly week with claiming but the Samsung pretending the IMEI of the mobile phone does not exist :-( I had a chat with some persons from Argos but they can do nothing about that

Sure I have sent them every evidence of buying but no help at all

 

I have sent one email as shot to trading standard but do not believe a lot

Ok, I have bought phone from Argos and tried to make a claim on Samsung website but the website says we did not recognise the IMEI.

I have tried Argos support then Samsung support but no success so far. I tried to find some similar stories as mine and did find this website

As I requested in my original post in this thread – post number two, we would like to have the whole story. This means how you bought the phone, the date you bought the phone, the price you paid, how you paid, et cetera.

Also it would be helpful if you posted up an image of the number on the screen as you have sent it to Argus/Samsung and also does this number coincide with the number which presumably is printed on the side of the box?

 

It would also help to know how Samsung/Argos have expressed the refusal – by email? Can you please copy it out here? What were their exact words?

It would help if you would simply address the questions we ask and then we will save a lot of time. Thank you

I want to see how clear the image is. You can redact a couple of the digits.

As the number on the screen the same as the one on the side of the box? You haven't answered this.

What form did the refusal take? You haven't answered this.
Is the £50 cashback offer from Argos as part of their deal? Or part of a Samsung deal?

Firstly it seems to me that Samsung is obviously used to these numbers not being recognised because from what you have posted, they have a procedure for dealing with this. Presumably you have satisfied that procedure and they still don't recognise the number.

Secondly, I think that the entire contract is with the retailer – Argos – and that means that it is Argos which is responsible for making sure that you are able to get your £50 cashback. I have no doubt that Argos will tell you that it has nothing to do with them and it is all to do with Samsung – but I disagree – and also I think it would be an easier matter to attack Argos on this if you are prepared to go to the trouble. I can imagine that if you try to go against Samsung that they might try to pass the buck to Argos. That is typical of these kinds of arrangements.

Samsung is the promoter. You have no contract with them. Your contract is with Argos and your contract is basically that you purchase a mobile phone for a certain price and part of the deal is that if you satisfy certain requirements within a particular period of time then you are also entitled to receive £50 cashback. Argos make this clear on their website and this is part of their offer to you which is intended to persuade you to buy.

Of course Argos won't like this and it's now up to you to decide what you want to do about it. You could send Argos a letter complaining – but they will knock you back. You could decide to begin a small claim in the County Court in which case you would have to send them a 14 day letter of claim and then begin the action.

You could try to take the easy route which is to deal with the Samsung cashback team to begin with – but if it came to nothing then I think eventually your complaint is against Argos.

In the meantime I would make sure that I had full screenshots of the offer on the Argus website and also anything else – terms and conditions et cetera both on the Argus site and also on the Samsung site so that you have a full file of evidence if you end up having to take formal action.
