the Claim number stays the same.    Personally I would wait for the eviction notice from the court, the fee will be much cheaper - if the court say they have received the request for eviction from the lender then it won't be long before the notice arrives with you.   If you post the N244 pack by special delivery the day the eviction notice arrives, they will get it the next day, they will then phone for payment (make sure you have put a contact number on the form, and then carry phone around with you, so you don't miss their call).

You can do, although they will know what it is from the claim number.   Take a photocopy of the notice and paperclip it to the front of the N244

In the letter I sent to lender, being included with N244 pack, should I also include copy of the postal receipt & their signature, or is that not necessary?

Still no eviction notice received. I did receive a letter today addressed to one of my neighbours, so am a bit worried that the eviction notice could have been delivered to wrong address.

 

It was applied for on 3rd June - Should I have received eviction date by now? Will this be hand delivered or through the post and should I also receive confirmation from Britannias' solicitor? 

 

Do you think I should email the court or the lenders solicitor to ask if they have an eviction date? 

 

Also, should I put anything in writing to solicitor informing them that I will be defending any eviction?

If the eviction was applied for on 3rd June,  it would take some days for the court to register it - as most courts are extremely busy it could be up to 2 weeks before you actually get an eviction notice  - it could be hand delivered or delivered in the post , I've known it be either way -and the date for eviction could be up to 2 weeks after that - so the court will give you a hearing date before the actual date the eviction is due to take place.

 

You could email the court and ask if they have a date yet - but I wouldn't send too many emails,  it won't make it happen any faster and they may get irritated by having to answer too many times.

 

No point in emailing the solicitors - they won't know any more than you do - they will be advised of the hearing date at the same time as you. 

 

You don't have to tell the solicitors you are defending - the court will do that, they send them a copy of your N244.

All you can do at the moment is wait for the eviction notice.  You don't need to be constantly going over what else you can do - there is nothing else to do.

I know it must be frustrating having to wait, but that's just the way it is I'm afraid.

And Yes. It is VERY stressful - Being berated for asking any question or needing support is not really helpful.

 

I guess I'll just have to wait a bit longer then and have more sleepless nights worrying if I'll actually be given enough time to try to defend. I live in hope

They certainly won't cancel the proceedings at this stage.

 

I don't think you've been berated for asking questions - all I'm trying to do is to get you to stop stressing yourself further by looking for other avenues which don't exist.

 

Furthermore I don't think you can complain about the support you've had - it's certainly more than most - 201 posts in fact

This is my home at risk here and I don't think being told off for asking any perfectly reasonable question is going to make me stress any less. 

 

I don't think I was making any complaint about the support I've had and have repeatedly expressed my gratitude... Am pretty shocked at some of the remarks though.... which I don't really want to repeat... Again, just don't want to lose my home don't think any of my questions have been repeated or unreasonable. 

 

To be frank, If it wouldn't do any harm, I'd rather try to do something in the meantime of waiting for the eviction notice to arrive, as I would obviously prefer to not have to go to court at all if theres any possible chance of getting them to consider cancelling their action .

At this stage, unless you can pay all the arrears there is no way they will stop the process, so I think you'd be wasting your time.

Agree, what offer can you make to Britannia that goes substantially towards the arrears ?

 

And what evidence do you have that you can reliably pay the mortgage each month as well as cover any remaining arrears ?

 

If you can start work again from August 2019, what evidence can you show a Judge, which would convince them that you will have the employment earnings to be able to pay the mortgage payments on time each month ?  Do you have copies of contracts from employers/clients, which show how much they will be paying you and when ?

 

To be obtain the mortgage originally, you would have needed to show evidence of earnings over a period of time. For self employment, mortgage companies require accounts for at least the previous 2 years.  Having gone through this process of proving your finances, you will hopefully have full records of your employment income, previous contracts for work you have done, Bank statement, financial accounts etc.  It might be worth having this proof available , just in case it was ever questioned whether you ever had the financial means to make mortgage payments and therefore there is no evidence that this is likely to change.

Really worried I will only receive a couple of days notice, or no notice at all... Does that ever happen?
