I've been advised that as I have been making payments to this debt, I will never get it statute barred.

it's now time to try and pay it off before they send me a PAP.

Before I do anything (like sending of an SAR) I just want to check in with the megaminds on CAG.

 

My plan would be to:

  1. Send an SAR to Virgin
  2. Find out how much of the balance is charges and interest
  3. Start a repayment plan/pay the remaining balance.

 

Details of the debt:

  • Credit card
  • £3500
  • Moorcroft last contact Mar 19 offering 60% off
  • Arrow last contact July 18
  • virgin  last contact Apr16

Yup, it might not matter if the account is Statute Barred or not, if they can't fulfill a CCA request. It will not be enforceable if they have failed to produce a CCA after 12 + 2 days.

On the CCA form the top line is 'Their Address', i assume it means i put down my own address?

 

I am making a £1 a month token payment. Should I cease all payments, or continue?

their address means their address not YOURS!!

 

once they or anyone you are blindly paying fails the CCA request after 12+2 working days

your option to cease payment until they comply exists.

Shouldn't I put my address on the letter, so they know where to send the reply to?

 

Or is it protocol that they send to the reply to the address they have on file for me?

I haven't moved, and they do have my address o file.

 

Are there particular addresses I should use for MBNA and Arrow?

why don't you LOOK and read the CCA request and the other posts in that topic??

look at the top right of the letter template...what does it say in black??

 

as for the addresses 

arrows will be on their letters to you

and mbna will be in this MBNA forum address sticky about the 1st post or so.

go back to the front page where your new started MBNA your topic

-1st class recorded

-£1 postal order stapled

-not signed

 

I am keeping payments going for now

 

The postal order is crossed and ive put 'Arrow Global Limited' on it, does this matter?

Got a handwritten reply on a compliments slip today advising they no longer charge for information, and that they will look to action my request as soon as they can. My original PO has been given back to me.

No reply from the SAR yet. Have i sent it to the wrong address?

Arrow have failed the CCA time limit, should i cease the £1 payment?

I've had a letter through from Moorcroft advising if we pay £1000, they will advise Arrow that the debt has been partially settled.

I'm more than happy with this; is there a proper way to go about remitting payment?

What happened with your CCA?

 

Dunno about you, but I certainly don't have a spare £1k to throw on the bonfire right now which is what you will be doing if there was no response to your CCA request.  I mean if it's really burning a hole in your pocket there are plenty of charities / food banks etc that you could give it to.  Far better causes than Moorcroft / Arrows etc Office Christmas party.

 

Partially settled marker is pointless anyway as it will be dropping off your Credit Report soon anyway. Do not fall for this con.

When was the default date? If it's ok to ask what reason do you need it off your credit file? Not that a partial settlement will remove it anyway.

It will fall off 2022.....paying a £1000 is pointless..wont move the marker any quicker...marked as Partially Settled irrelevant...your simply easing Moorcrofts cash flow problems to see them through the current climate.....leave it in the bank.
