      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've been advised that as I have been making payments to this debt, I will never get it statute barred.

it's now time to try and pay it off before they send me a PAP.

Before I do anything (like sending of an SAR) I just want to check in with the megaminds on CAG.

 

My plan would be to:

  1. Send an SAR to Lloyds
  2. Find out how much of the balance is charges and interest
  3. Start a repayment plan/pay the remaining balance.

 

Details of the debt:

  • Credit card
  • £3100
  • Wescott last contact Mar 16
  • Lloyds last contact June 18, advising they've credited me with £200 as 'they did not always take the appropriate course of action'

Wescot Clients are Lloyds Bank PLC.

I have already asked for a CCA, which they responded to in the correct time, this is in May 2016.

I am making a £1 a month token payment.

Should I cease all payments, or continue?

as the card is still owed by the OC, and as you've seen, they usually are able to comply, then its enforceable.

so no don't cease payment.

 

however get an SAR running.

you should have been reading up on charges reclaiming in the down time.

Do i put down 'Cardholder protection plan' as well?

Obviously this is PPI. on a seperate note, i did claim for this many years ago but they refused to pay out.

 

On my statement, ive got 'date of transaction' and 'date entered', which date do i put down?

CPP was an annual card protection policy administered  by a sep company ..not levied by the original creditor.

your claim was against CPP but you are now out of time I suspect.

Sorry, in my SAR, Lloyds sent info on a previous credit card i forgot about.

I'm now going through the statements that relate to this topic.

I've filled out the form. I've included interest, as well as late charges, is that correct?

For the claim from and to, do I put the date of the first and last transaction?

This debt has now passed to Link and there are now two accounts for the same debt on my credit report, one new one for Link, and the existing one for Lloyds. In your experience is this normal? Will the one from Lloyds disappear in a few weeks?

not been passed, read the letters properly, it's been SOLD.

 

2 entries are quite normal and as long as the fleecers dont change the OC's registered defaulted date, its not double harming your score as its the same debt.

 

yours is not the next move.

Hi DX, correct in saying it was sold.

I'm not paying anyone a penny, havent done for about two years, still a few years off being SB.

Thankfully, the debt defaulted about six years ago now, so should be dropping of my credit file soon.

I've check the default date on the new Link account and its the same as the old one.

Looking at my records, the date of default was Jan 2016, so I am thinking that this should have dropped off my credit file in January 2022, however this hasn't happened yet.

Whats the process for an item dropping off the credit report? Does it go into the 'Closed' section? Does the amount go to £0?

Do i need to raise a dispute with Trans-Union?
