However I have a new problem
I sent the car to a Mercedes Repairer and they have damaged the sump, asa result I now have an oil Leak quite badly on my drive whereas previously the car had sat on my drive for a considerable amount of time and no oil leak, now the car is repaired and I have a bad oil leak.......the repairer has said it isn't his fault and said it was cracked before he touched it and somebody had over torqued the sump plug.....if thats true, why not raise the concern with the workshop controller prior to fitting the new plug?.......so now the garage has fitted a new sump plug and it shows witness marks of over torquing ( tightening) the plug and then sends me a video prior to me picking the car up....telling me that I have a cracked sump?? .........I have told the repairer that a third party engineer can confirm that the engine wasn't leaking from the sump plug.
I took out short term finance for the repair which amounted to £1k plus with the first payment and VAT paid up front........

Not the Driver.
1. Signage Forbidden + inadequate. Give example. Explanations.
2. Notice to driver no compliant. Give example explanation.
3 NTK not compliant. Give example, explanation.
4. Further to this the defendant does not believe that the claimant has locus standi. In any case no contract was offered by the claimant to the defendant.
5. Challenge alleged contract. Give explanation.
I have also a list off points to make against there WS.
One last point they have supplied Picts in there WS, i have Picts that question their accuracy, can I take them with me to court, to late for my WS.

in no particular order the reason I think that no legal brain is involved in the process until much later is that I was told on another forum these are laughingly referred to as roboclaim on another forum. I was told what the next letter in the sequence would be before it arrived and to test the theory that I was conversing with a computer in December 2017 I sent them my joke response on a Christmas card and got the predicted reply. Finally and most significantly I pointed out that they had exceeded the 56 days they are allowed to serve the NTK over a year before BW Legal binned it
Don't touch them owe me £500 since January 2019 make excuse after excuse. Seem they always have software problems sending money out. Keep saying they will call back or email nothing been chasing it now for 6 mths the phone staff always have the same banter we will chase it up and get back to you then nothing!
