    • just say ppi/associated insurances.   I was told they were compulsory for my situation and type of mortgage   why are you not getting things after all this time? is 'life assurance' PPI ... no!! so don't tell them..paint the impression that other were bolted on to the PPI else you'll only get the PPI back.   simply reply as I have stated and wipe out elsewhere if you said about the other insurances being life or whatever they are NOT PPI so if you label them such, you cant associate them into a PPI claim. and you wont get a refund on them please be careful upon words used throughout you submission          
    • Hello   A team of ticket sellers tried to overcharge me at a station.   I had a 'permit to travel ' from my departure station ( a machine that allows one to put a deposit on a ticket with a coin) as the main ticket office was closed. So I was legal to travel.   I asked to buy a ticket at the turn-styles on my arrival/ destination station.   The staff would not let me have off peak fare, they adamantly insisted I pay 'on peak' which is allot more and detained me.   I knew they were trying to over charge me. but what could I do ?  I was trapped behind the turn-styles, I was not allowed to go home on the train or leave into the town. I could not walk away, it was quite stressful.   They even said its my own fault for not buying a ticket at the departure station.  (Even though it was closed, hence the permit to travel ticket I had!)   In the end, after a debate, I had to agree to be overcharged to get out the station!  They threatened a terrible fine if I refused to do so.   However, I then checked with the main office on the way out and they said they had indeed over charged me and I had to go back to the turn-styles to get a refund.   I went back to the turn-styles, I told them they were overcharging me, as head office said so, that this was not the first time for me and I have seen it happen to others (I have evidence). They reluctantly gave a refund. They were not very happy about it, with zero understanding of why this was unfair.    In my mind it felt like this:  Just give a refund and " who's next to be overcharge?"   no care for the future customers at all.   There was no indication of why this happened or that it should never happen again. These people are meant to be trained experts. And they know very well when it is on peak or off peak times!   However,  this is not just about me. I said that a refund is not good enough by itself, as this has happened before. A refund does not solve this problem for other people. and i asked what are you going to do about it?   The supervisor again tried to blame me for not buying a ticket at the departure station and said it was my fault and...without a warning. The supervisor called a security guard and told me to get out the station. A security man ushered me out.   With no refund. I asked could I have one, he said no, get out! I asked if I could use the overpriced ticket to go home, the guard said no and that I had to leave!!   Any views on this would be great thank you.

    • Better?   What happened when you took out the payment protection insurance:   In xxxx I had a loan with you which had PPI added to it.   When I started my mortgage with you in 1997 a ppi/life assurance was added.   Finally, tell us now why you are unhappy with the policy(s) that you purchased:   I didn’t know the loan ppi was optional or that as this was added at the start of the loan I then paid interest on this as well.   I was told life insurance/assurance was compulsory for my situation and type mortgage and only recently learned this is not the case.

Reply from PRA received today:

 

Thank you for your dispute which was received in our offices on 11 June 2019.

The purpose of this Response letter is to explain the results of my investigation into your dispute. I have made every effort to investigate your dispute thoroughly and fairly.


Your dispute

I understand form your Pre Action Protocol that you are disputing the account and have requested documents relating the account.


Response

When I received your response I contacted the original creditor, who were able to supply me with documents, I will list below the documents we received.
1. I was unable to receive a final demand , however I have included a screenshot provided by Lloyds as to when this was sent, the account was defaulted on 4 March 2016.

2. Notice of Assignment

3. Statements 9 February -1 March 2016.

4. Unable to obtain statement of all transactions.

5. No additional charges when purchased.

6. Interest and charges would have been in keeping with the agreement

7. Payment Transactions while in recoveries, this also covers payments made to PRA Group.

 

I confirm that the information provided fulfills your PAP request, as such the balance remains outstanding

 

Next steps

I will place the account on hold for 30 days , if we do not hear back from you within this timescale, we will proceed with legal action.


I trust that this now clarifies our position in relation to your dispute, however if we have misunderstood any element or you have new information that we should consider please contact our Disputes Team on 0800 877 2150 or disputes@pragroup.co.uk quoting the dispute reference number xxx

What next?

 

It almost looks like the envelope had been had delivered. The address didn't fit the window of the envelope, it looked like it had already been opened. And there was a post-it-note on it.

 

Along with that letter i got:

  • A screenshot of something showing our names and where the account has come from
  • Copies of letter from Lloyds and PRA advising us the debt has been transferred from Lloyds to PRA
  • Bank Statements
  • Copy of our application form
  • List of £1 payments made

in other words they cant disprove what you complained about ..its all historic charges mate..

I've got the statements in front of me and there's only £600 of charges. The account has only been open since 2012.

if you read back your thread

you stated it began in 1998.

just because your credit file or an sar only gives 6yrs of data that doesnt mean thats when it was opened.

I did mention in post 46 that it was actually opened in 2012. I couldn't go back and edit my first post, as the forum only allows you to edit a post for about five minutes after you post it.

So what now, call and make a deal?

Totaled all charges and fees and its just over £1k

Hi @dx100uk,

with regards to the account fees, my reason doesn't seem to fall into the categories mentioned, what shall i put down?

 

With regards to the overdraft interest and useage fees, how do i go about claiming that back?

 

@dx100uk, @AndyorchSo the advice now, is to ignore PRA's threat of litigation, and see what they do?

 

Looking at PRA's response, they've failed to provide all requested information.

 

Does this actually mean they've failed in their duties?
