    • I'm removing two posts here – one because it refers to "… All from the same ethnic background" and the second one referring to the fact that the customer was Spanish. The first, particularly by king12345 has a strong racist tone about it and is completely unwelcome here.  king1 2345 has been here long enough and knows very well that this is not what we do. ==============================================================================   In terms of the building and insurance problem, it certainly sounds if you are being treated very badly and we would be very happy to help. Unfortunately I find your story is rather unclear – probably because there is a lot of narrative and I'd be grateful if you could clarify your story and in particular breaking down the insurance job and the rest including giving their values. Do you know if the insurance money has been paid to the customer or is the insurance company simply waiting for some kind of approval. You say that the insurance company has signed the job off and so this suggests to me that they are satisfied but what worries me is that they may already have paid the money to the customer who is merely withholding it from you rather than authorising the direct payment of the insurance money to you. Your story needs substantial clarification please. Finally, does your customer own the property? If you are not sure then you should consult the land registry website to ascertain the owner of the property

    • Thanks DX re counterclaim. Just to clarify regarding witness should I just put one on the N180 and at court just take a witness statement from partner?  
    • I am hoping someone can advise me regarding my salary. I work as an emergency response driver for a private medical transport company. I work 6 x 24 hour shifts on call(total of 144 hrs) followed by 2 rest days(48 hrs). I work from my home address, with a company vehicle parked outside. During my six on call shifts, I must be available to respond to any task given to me (by phone-call) within a certain time. As you can imagine, while on call I am very limited to what activities I can take part in. Due to the nature of my role and the need to respond within 30 minutes to 90 minutes I am somewhat tied to my home. Obviously I cannot consume alcohol, go for family meals, go shopping etc. Even while attending hospital appointments, popping to the shop I must wear my uniform, take the vehicle with me and be contactable and ready to respond. It has been brought to my attention that on call time is now classed as working time if you must be at the disposal of your employer during that on call time.   Is that correct and if so, should I be paid at least the minimum wage while on call. I am currently paid an annual salary of £22,000 for being on duty an average of 6,570 hours per year which would put my hourly rate at well below the minimum( not including annual leave).   Any advice would be greatly appreciated. Thank you.

as already explained if you read your thread from post 1 again

they don't have to default the debt upon sale or earlier but typically do

probably appear once lowells entry pops up there soon I expect.

The agreement has been assigned and the amount wrote to zero therefore the account has been terminated.The fact that they have not registered a default is in your favour in one way.,the lack of default notice and more so the lack of Notice of sums in Arrears prevents the creditor from charging any interest or even enforcing the debt through court,  but it does not mean they have not defaulted you internally on their own systems...only D SAR could reveal this information.

 

Section 11 of the CCA 2006 amends the CCA 1974 - 86D - that sets out the consequences for a creditor if he fails to notify as required by sections 86B or 86C.

If the creditor fails to provide a notice when required to do so, then throughout the period of his failure (i.e. from the date that it was required to be given until the end of the day on which it is eventually provided), he is not entitled to enforce the agreement.

In addition, the debtor or hirer is not liable to pay any interest that relates to the period of the creditor or owner’s failure,

Even bigger issue is when Lowell submit the claim form...better to be prepared.

There’s no AP markers since my last payment back in December 2018.

 

what is a DSAR?

 

Is it worth sending a SAR to Hitachi to find out what they have on me or is it likely that Lowell will have everything now ?

Yes DX, but my whole aim was to get Hitachi to default me , because once i set up payment arrangements after default , AP markers won’t be recorded.

 

They just record the payments on the CRA and reduce the balance each month ( the same that Cabot have done with me for the last two years with another debt )

if ap markers are not being reported you don't want nor need a default.

the only benefit of a default is to eventually get the AP markers removed when it hits its 6th birthday or get the defaulted date moved to the third AP marker as some do.

 

start another thread for the cabot debt.

what is saying is ...once i set up a payment plan with lowell then AP markers will be recorded whereas if it was defaulted prior by Hitachi  then they won’t show when I set up a DMP with Lowell .. are you with me ?

I doubt they'd mark it as AP anyhow.

why did hitachi sell the debt on for 10p=£1

why didn't they take you to court and crush you??

something is wrong..

 

have you had a letter of claim from lowells solicitors yet?

have you sent a CCA request? [if not don't yet]

Er more than likely probably not,

 

Of my 50 k of unsecured consumer debt, that I completely ignored, 45 k went statute barred years ago and long gone from my credit files. 5 K that I had to repay were back door CCJ's that if I'd have paid attention to this forum, I never would have had to pay back either.

They only brought the debt at the end of June.

I haven’t made any payments to Lowell.

This letter i received yesterday from lowell was a ‘ Pre Legal Assessment ‘ stating that they may take legal action to recover the debt if i do not contact them to arrange a repayment plan!

and no CCA request yet

I just shredded a ream of DCA letters from the last 10 years saying they 'may' take legal action, and never did.
