    • So to clear up, you think you've paid this £1200 as part of the £4000, leaving a net overpayment of £2800 (which you don't want back?) Can you provide proof of payment (bank statements for the standing order) showing that you've paid this £4k over? Do you still have to pay for the child currently? In regards to your second query re: PiP it's only a press release right now, nothing has been confirmed. Just remember it's election year so there's no guarantee that the current or any future governments will follow through with it.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Dear Victim

Following a court hearing on 25 April 2019, the Joint Administrators of WDFC UK Limited (trading as Wonga.com) include links below to two statutory notices that are being provided to you as someone who has submitted a claim or may in due course.


1. Notice of intention to declare a dividend

This can be accessed by the link below:

Please note that in order for the Joint Administrators to set a final date for those who are owed money to submit a claim, they must issue the notice in the link above. As you will see from the notice, all claims must be submitted by 30 September 2019 or they may not be considered for payment. It is expected, unless you receive a notification to the contrary, that the Joint Administrators will make a payment to accepted claimants within four months of 30 September 2019, i.e. by 30 January 2020.

For those claimants who have already submitted a claim, no further action is required from you at this stage and the Joint Administrators will be in touch when they are ready to assess your claim.

If you have not yet submitted a claim and believe you have been sold an unaffordable loan by Wonga, as per our previous correspondence, all customers should make a claim through the Online Claims Portal by clicking on the button below.

Submit your claim now

Please be aware, if successful, the payment you receive will be considerably smaller than your accepted claim amount. This is because it is expected that the total value of all accepted claims received will significantly exceed the money available to be shared out. The money available to be shared out will not be known until all of Wonga's assets have been sold or realised and certain costs and deductions have been taken into account.

2. Notice of extension of administration

An Administration is typically a 12 month process. As explained above, it will not be possible to collect in, assess and pay money to claimants within that time period, as such the Joint Administrators have had approval from the Court to extend the Administration by a further 12 months (to 30 August 2020) and the statutory notice above confirms this.

No further action is required by you in respect of this notice.

Slight Update - All payments should be made by the end of this week. However the Customer Service Team are unable to say how much is due as they "Dont have access to say" 

Payments should be made by BACS to your Bank Account.

You will receive a payment of £5.79. Your payment represents 4.3p in the £ on your agreed claim value of £134.25.

Please note, if you are represented by a CMC/Third Party and have provided us with instructions that your CMC/Third Party representative should be paid on your behalf, the above amount will be paid to your CMC/Third Party representative directly.

As you will be aware from previous correspondence to you, the payment you will receive is significantly smaller than your Accepted Claim Value. This is because the total value of all accepted claims for customers/creditors significantly exceeds the money available to be shared out.

As per our previous assessment email, we have also taken steps to update your credit file in accordance with the outcome of your assessment. All credit file updates in association with this claim should be completed within approximately 45 days of this correspondence.

If you are being represented by a CMC/Third Party, a copy of this email has been sent to your CMC/Third Party representative.


When will I receive my final dividend payment?

As a result of the volume of dividend payments due to customers/creditors, you will receive your payment within four weeks of this email.
