    • I contacted my local Councillor and received a reply this morning, saying the he would kindly contact our local council on Tuesday morning to see if they could offer any advice.   He also suggested i contact CAB.   It was kind of him to respond so quickly, but unfortunately does not resolve the immediate concern of a potentially scary doorstep visit.   My poor mum has been baby sitting this morning and was terrified!    
    • Hi  was wondering if anyone could help.  Received some quite crazy letters from ‘CLI International Debt Collectors’ about some apparent outstanding debts (speeding fines) from Italy. I was under the impression these were cleared off and have never heard from the Italian motor people for over 4 years now and then randomly got these through the post.  There have been 4 letters - 3 saying what the debt is (no dates or ticket refs though) and then one about how they will now be sending doorstep collectors unless contact within 7 days is made.  Now I have been ignoring but I’ve seen some forum posts about this company but dating back to 2017 so I was wondering if the same sort of rights applied and I can keep ignoring or is this something I should be worrying about? 
    • the delivery co arent going to do anything because their diver left the scene without exchanging details and will get clobbered for a criminal offence of failing to do so. What I would do is sit on my hands and see if they make contact with you, if they do you go along with it, if they dont then there is nothing to report unless you want to claim on your own insurance
    • then that will be part of your defence, no ticket on vehicle and the NTK was issued too late to cretae a keeper liability. In the meanwhile you check with the DVLA whe your detailes were accessed, by whom and for what stated reason
    • if they dont respond you can say in your defence that you do not believe they have the permissions because they have failed to produce them and thus have no locus standi.

    • This is a bit of a lengthy one but I’ll summerise best as possible.
       
      THIS IS HOW THE PHONECALL WENT 
       
      I was contacted by future comms by phone, they stated that they could beat any phone contract I have , (I am a limited company but just myself that needs a business phone and I am the only worker) 
      I told future comms my deal, £110 per month with a phone and a virtual landline, they confirmed that they could beat that, £90 per month with a phone , virtual landline  they also confirmed they would pay Vodafone (previous provider) the termination fee. As I am in business, naturally I was open to making a deal. So we proceeded. 
      Future comms then revealed that the contract would be with PLAN.COM and the airtime would be provided by 02, I instantly told them that this would break the deal as I have poor 02 signal in the house where I live as my partner is on 02 and constantly complaining about bad signal
      the salesman assured me he would send a signal booster box out with the phone so I would have perfect signal.
      so far so good.....
      i then explained this is the only mobile phone I use for business and pleasure, so therefore I didn’t want any disconnection time in the slightest between the switchover from Vodafone to 02
      the salesman then confirmed that the existing phone would only be disconnected once the new phone was switched on.
      so far so good....

    • The FSA has announced large fines against DB UK Bank Limited (trading as DB Mortgages) - DeutscheBank and also against Redstone for their unfair treatment of their customers.
      Please see the links below for summaries and full details from the FSA website.
      It is now completely clear that any arrears charges which exceed actual administrative costs are unfair and therefore unlawful.
      Furthemore, irresponsible lending practices are also unfair and unlawful.
      Additionally there are other unfair practices including unarranged counsellor visits - even if they have been attempted.
      You are entitled to refuse counsellor visits and not incur any charges.
      Any charges for counsellor visits must not seek to make profits. The cost of the visits must be passed on to you at cost price.
      We are hearing stories of people being charged for counsellor visits for which there is no evidence that they were even attempted.
      It is clear that some mortgage lenders are trying to cheat you out of your money.
      You should ascertain how much has been taken from you and claim it back. The chances of winning are better than 90%. It is highly likely that the lender will attempt to avoid court action and offer you back your money.
      However, you should ensure that you receive a proper rate of interest and this means that you should be seeking at least restitutionary damages - which would be much higher than the statutory 8%.
      Furthermore, you should assess whether the paying of demands for unlawful excessive charges has also out you further into arrears and if this has caused you further penalties in terms of extra interest or any other prejudice. This should be claimed as well.
      If excessive unlawful charges have resulted in your credit file being affected, then you should take this into account also when working out exactly what you want by way of remedy from the lender.
      You should consult others on these forums when considering any offer.
      You must not make any complaint through the Ombudsman. your time will be wasted, you will wait up to 2 yrs and there will be a minimal 8% award of interest and no account will be taken of any other damage you have suffered.
      You must make your complaint through the County Court for a rapid and effective remedy.

I took out a PiggyBank loan a couple of years ago but ran into financial difficulty so stopped paying.

The debt was then sold to ACI in 2016 and I began an IVA and the debt was included and is being repaid.

 

I recently won a claim for being mis sold loans by PiggyBank and was told I would be given £370 as a goodwill gesture from them.

 

However PiggyBank are now refusing the claim saying they are holding the money to cover interest that I occured when I had the loan.

 

My question is if the loan was sold to ACI surely the debt that was sold includes any interest and because I am in an IVA and im paying that debt they cant hold the money ?

it should goto the IVA trustee

have you told them

and about any other refunds?

if you haven't you are breaking the terms of your IVA

which is probably a good thing as did you or anyone check all your debts for enforceability before you entered into the IVA?#also do you mean it was sold to AIC not ACI?

The IVA company knows whats going on and they have said they will continue to collect the debt and amount as agreed. Its the only refund ive been awarded and I know anything that comes my way over 500 has to be declared to the IVA company. 

That isnt the issue the issue is im already paying the debt to PiggyBank through my IVA yet they are saying I owe them interest. If a debt is sold then any interest occured is sold with it surely?

they cant refund you what you haven't paid nor are going to.

are you saying you made an irresponsible lending complaint and this refund is as a result of that.

How does it not make sense??

 

I took out a loan with PiggyBank stopped paying due to a change in circumstances, they sold the debt on to Asset Collections.

I took out an IVA and this debt is being paid through that.

 

A company advertised about reclaiming any mis sold payday loans...loans that were rolled over without any questioning.

I filled in the form

 

they said Piggybank mis sold me a loan and PB agreed to give me 370 as a gesture of good will.

However upon getting the payout PB said they will be keeping the money to pay off the interest that was added when I had my loan with them.

 

So they sold the loan yet are saying I still owe them interest even though its being paid off to Asset via my IVA

 

I AM paying the debt via my IVA to Asset Collections whom PB sold the debt to

a series of loans, so they've actually refunded from another loan and not the one subject to an irresponsible lending complaint?

pers I know what i's do

 

first

write to the CMC and cancel any outstanding claims and this one and pay them off any fees for the refund [ even though you haven't or wont get it, they'll still want their fees] they have gotten you. shame you used a CMC you could of done this properly and all for free yourself.

 

when that's done goto the FOS.

but you'll need all the paperwork to show what has been done to date so send the CMC an sar to get that.

 

as for the IVA might be better to start a new thread in the IVA forum and lets get the debts checked for enforceability, cause if you are paying one off that's now owned by a no powers DCA, odds on you have others.

 

you state in one post you are paying asset through the IVa..in another you say piggybank..which is it or both>??

ok good asset are a PDL debt buyer.

can you start a topic on this IVA and list the people paid throught it

you could be being cashcowed here and paying fees to the provide too that you might not need too.
