      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Romulus, I know you have posted the car agreement...can you post the 2 loan agreements for us to see?

 

Silly question but do either of them have PPI and what years were they signed?

Afternoon all, popping in, Romulus, I am sorry I did nto get back to you about your agreements yesterday...I actually fell asleep at stupid o clock going over them ...but need to ask - you said you and your partner were self employed, is that officially self employed? If so the PPI on one agreement is missold. I can't see anything really out of place on them but had trouble getting the figures to add up? Will have to try again!

 

Why is it you have to phone them today?

 

To all regarding the secured loans...dig deep. If you find anything amiss on their submitted paperwork that has cost you anything then it is a breach of section 1 of the Fraud Act 2006, complain bitterly to the registry as they are meant to have checks (sigh)

We missed all 3 payments this month due to this rubbish economic situation! We had not missed any payments until now. So gutted it had to be to them Bastards. They want me call today to arrange some kinda of payment but alas mortgage due next week so Welcome will have to sing!

 

They asked me if I wanted to consolidate all 3 for a lesser payment also!

 

Obviously the consolidation would make financial sense but from reading posts from you guys I don't want to be drawn into a secured loan with these sharks!

 

However, a new loan agreement would release my car so I could buy a much needed new one as alot of my money is repairs for that heap now. I've spent around £5k on it since I got it! I live in NI so was not purchased from a Welcome showroom.

And there is your complaint - wahey! Send them a letter firstly lodging a complaint, ask for their complaints procedure. Complaint is missold PPI, then failing to cancel and failing to amend your agreement to reflect the change. Also send the letter I can give you in a mo thatsays all contact in writing, nothing verbal, you do not gove them permission to visit your home balh ablah.- all recorded, print do not sign.

Dipply does the missold ppi mean that it shouldn't be sold to self-employed

 

 

self employed people should not be sold PPI - it's worthless.

 

I know someone who complained to DG about this not so long ago and DG 'ordered' Welcome to repay the money - I think that OP is still waiting for his money back though.

You may be also awarethat you have a right to return the vehicle and scrap the agreement if you have paid 1/2 of the amount section 100 of the act.

Welcome do not like this but i have done it in the past and it is not easy but it can be done.

I asked for a settlement figure last year on the hp agreement and the figure they gave me back was a joke and in the end I didn't have what they wanted. Do they front load their loans and if so is this legal?

Hi folks been a while haven't done much by way of Welcome but have had a letter or 2!!!!! I received one for a personal which went unpaid last month and also a statement but have not received anything for a carloan which also went unpaid! Wonder if maybe just maybe they've mislaid my agreement........................

Hi Folks haven't been around in a while!!! Wow so much to catch up on....

 

I have unfortunately been unable to pay my car loan with Welcome for 3 months now. The money was in the account this month but apparently they cancel the DD after 2 months of non payment. They have sent me various letters which I have ignored as some people do in the hope they will go away..... Anyways back on track now and ready to sort my crap out.

 

I need the car for work as I'm a driving instructor silly not to pay I know but the mortgage was the priority. They have sent me a WITHOUT PREJUDICE letter too stating they I will be commiting an offence if I fail to comply within 14 days etc.....

 

Help please!!!! Just want some advice before I contact this shower of Tankers.

 

Btw I will probably be moving back to London within the next month and may be handing the heap back anyway.....
