buypaintsonline - Completely wrong colour paint supplied

Hi everyone

 

I ordered some brand exterior paint online from a retailer.

I ordered a darker green just in case it came out lighter on drying.

 

What they have supplied is a bright turquoise definitely not dark green.

I have advised them with 48 hours of delivery that it is completely the wrong colour.

I have supplied pictures of the paint in tin as well as a small test piece as requested by them and codes on tin.

 

They are saying that the paint I have is the right colour despite being completely different to their description and colour picture.

I realise there may be 2-3 shades difference depending on monitor quality, etc.

But this is bright blue not dark forest green.

 

Am I within my rights to request the correct colour or a refund if they refuse ?

It was a mixed colour listed on their website.

 

I read somewhere about online being covered under distance buying act or such.

 

Any help on the matter would be appreciated as this was not cheap paint.

This is an online purchase and you are entitled to reject the Items for any reason within 14 days. Put them on notice in writing and tell them that you will be returning the items and that you will require a full refund.

Which company are you dealing with please? How did you pay?

Hi Bankfodder It’s a company called ‘buypaintsonline’ and I paid with my visa debit card. It should be a dark British racing green colour and I have bright Caribbean turquoise blue. Lovely colour just not for my garden and def not what I ordered or was shown on their website

Well as I said, you are entitled to return it. If there is any argument about the money then begin a chargeback procedure with your bank. Go to trust pilot and put a review there. Go to Google and put a review there.

The colour of the pain doesn't matter. Within 14 days you are entitled to return it for any reason.

If your bank causes problems about the chargeback then come back here.

Bankfodder thank you so much for taking the time to reply and advise me. I will email them now and see what their reply is. If it is not satisfactory I will contact my bank Monday morning and begin the chargeback process. Fingers crossed it goes smoothly. Once again many thanks 👍

You can return because of wrong colour,  but not for ANY reason within 14 days.

It's a mixed paint to customer specification,  so if the product is fit for purpose, this would  be one of the cases in which the customer cannot simply change their mind.

Thank you King12345 it’s because it was mixed it was a bit confusing. Tbh if it was any shade of dark green I wouldn’t bother I’d work with it. But bright turquoise is a bit far off lol. Waiting to hear off their reply now before I contact my bank 👍

Wrong colour, automatic refund/replacement. 

I ordered from them before and a pot arrived half open with paint spilled out.

They sent an immediate replacement and let me keep the opened paint.

Maybe they didn't want to deal with this just before a sunny weekend...

Wait monday, i'm sure they'll send you the correct paint.

Hi King12345 I hope so as I’m not normally one to complain. But I’d checked Sadolin Superdec swatch colours in a local store before I ordered it. I still expected a bit of colour variation but not this much lol I’ll keep my fingers crossed 🤞

Hun guys, so I have heard back this evening from ‘buypsintsonline’ they say I can return the paint and uponnreveiving the paint they will issue me with a refund. However I have to pay for the cost of returning it as they say that the paint has been mixed and supplied correctly. So they are still saying that the turquoise blue paint in the pictures I sent is the right paint ? How can it be when it’s supposed to be dark forest green ? I’m not happy about paying return postage when it’s clearly the completely wrong colour. Any thoughts ? Thanks in advance x

do a chargeback.

if they want their paint back [why it will only go in the bin!!.]

let them pay for it to be returned.

I will be tempted to return the paint and then attempt to recover the postage afterwards – possibly by doing a chargeback

If you send the paint back make sure you keep a sample in case they claim it was the correct colour.

Hi

I’ve spoken to my bank explained everything and they’ve started the process of charge back.

They will be in touch by tues to arrange email of all my correspondence to them with the paint company plus the photographic evidence. They have said if the company wants the paint back then they should make arrangements (cost wise) for it as it is not what was ordered.

 

I have emailed the company stating that their conditions for returning the paint (as stated on their website) at my cost is only in the case of me changing my mind.

 

Since this is not the case and they have supplied me with the wrong product initially then the cost of return postage is down to them.

 

Had they supplied the correct colour of dark green then there would be no reason to return it.

So now I’ll just wait and see what happens.

Hi

after a few more exchanged emails where they still refused to acknowledge the colour error and reiterated that I had return it at my cost, they have now agreed a full refund.

 

After I advised them I would get my refund as the process was already underway and all photos and correspondence had been forwarded onto the relevant dept as evidence.

 

They do not want the paint back so will donate it to a local centre for autistic children to use in their sensory garden area.

Also very nice gesture to give the paint to the autistic kids. Have you let the retailer know what you have done with the paint?

Hi Bankfodder yes I did, they said that they were pleased it wasn’t just getting thrown away. I said that the autistic kids will love it as it’s so bright and colourful. I’m glad some good will come of the mix up 👍

    • Thanks for the advice, I will call the council Tuesday morning and see what they say, and then send the I/E form.   Something doesn't sit right with me on the whole thing.    I found an email I had sent to my MP early 2008 detailing the problems we were having with tax credits, and I go into great detail of our situation and  employment history.   Work was sporadical and I am pretty sure we were on benefits throughout one of those whole periods (I even had a post on here about the bank charges problem)   In fact most of those time periods mentioned in post 4 there was little work. Worst 2 years of our lives! I dont know how to find records of benefits though for that long ago.
    • I won a prize in a Raffle operated by an organisation holding an event at a local venue. The prizes were displayed on video screens in the venue and on a printed list by the person selling the tickets.  The prize I won was stated as "4 (four) weekend VIP tickets to Birmingham Pride"   - I did not open the envelope until the following day - it contained 3 (three) vouchers for weekend "Premium" tickets to Birmingham Pride (Premium being a lower priced ticket than VIP).   A friend who was at the event with me had the phone number of one of the organisers - there being no other obvious way to contact them - the person confirmed the prize was stated as 4 tickets, it was supposed to have been changed to 3, but that it had not been done.   I considered that this was suspicious, I can accept it might not have been possible to change the wording on the video screens, but the person selling the tickets could have clarified this verbally, and could have altered the "4" on the printed sheet to show "3".    As "compensation" I was offered free entry to their next event. That would be £7 per person (if they intended to include anyone else I was attending with) which in no way equates in financial or entertainment value of the Pride event, which has tickets priced £88.00, for two days of live acts including Marc Almond, Faithless and Human League.   I would like to know if the offer of prizes as originally stated and the exchange of money for entry in the raffle constitutes an intent to create legal relations - and as such, that I am entitled to 4 (four) VIP tickets (not Premium) and nothing else other than a cash alternative of equal value to the expected prize.   Incidentally, the vouchers state to send an email to an email address at birminghampride.com – which I did several weeks ago, but have not received any response.   I assume even if the Pride organisers fail to respond, the raffle organiser is still liable.
    • you realise Gick its very easy to make win 10 look like win 7.? I wouldn't move from 7 because I do lots of RS232 and other basic comms stuff with vintage gear and past 7 it would not longer do what I want.   win10 put everything back and works better than 7  ive even got it on a very old 1gb ram vio pc  if you want help pm me and I can sort things for you.

      THIS IS HOW THE PHONECALL WENT 
       
      I was contacted by future comms by phone, they stated that they could beat any phone contract I have , (I am a limited company but just myself that needs a business phone and I am the only worker) 
      I told future comms my deal, £110 per month with a phone and a virtual landline, they confirmed that they could beat that, £90 per month with a phone , virtual landline  they also confirmed they would pay Vodafone (previous provider) the termination fee. As I am in business, naturally I was open to making a deal. So we proceeded. 
      Future comms then revealed that the contract would be with PLAN.COM and the airtime would be provided by 02, I instantly told them that this would break the deal as I have poor 02 signal in the house where I live as my partner is on 02 and constantly complaining about bad signal
      the salesman assured me he would send a signal booster box out with the phone so I would have perfect signal.
      so far so good.....
      i then explained this is the only mobile phone I use for business and pleasure, so therefore I didn’t want any disconnection time in the slightest between the switchover from Vodafone to 02
      the salesman then confirmed that the existing phone would only be disconnected once the new phone was switched on.
      so far so good....

    • The FSA has announced large fines against DB UK Bank Limited (trading as DB Mortgages) - DeutscheBank and also against Redstone for their unfair treatment of their customers.

      It is now completely clear that any arrears charges which exceed actual administrative costs are unfair and therefore unlawful.
      Furthemore, irresponsible lending practices are also unfair and unlawful.
      Additionally there are other unfair practices including unarranged counsellor visits - even if they have been attempted.
      You are entitled to refuse counsellor visits and not incur any charges.
      Any charges for counsellor visits must not seek to make profits. The cost of the visits must be passed on to you at cost price.
      We are hearing stories of people being charged for counsellor visits for which there is no evidence that they were even attempted.
      It is clear that some mortgage lenders are trying to cheat you out of your money.
      You should ascertain how much has been taken from you and claim it back. The chances of winning are better than 90%. It is highly likely that the lender will attempt to avoid court action and offer you back your money.
      However, you should ensure that you receive a proper rate of interest and this means that you should be seeking at least restitutionary damages - which would be much higher than the statutory 8%.
      Furthermore, you should assess whether the paying of demands for unlawful excessive charges has also out you further into arrears and if this has caused you further penalties in terms of extra interest or any other prejudice. This should be claimed as well.
      If excessive unlawful charges have resulted in your credit file being affected, then you should take this into account also when working out exactly what you want by way of remedy from the lender.
      You should consult others on these forums when considering any offer.
      You must not make any complaint through the Ombudsman. your time will be wasted, you will wait up to 2 yrs and there will be a minimal 8% award of interest and no account will be taken of any other damage you have suffered.
      You must make your complaint through the County Court for a rapid and effective remedy.
