Hi all,

 

I have a fine from may 2018 from HMCTS, we got all the feeds ect. And agreed to pay monthly instalments to them, which we have receipts for.

 

Missed one payment in November and occurred admin and late payment fees (which we paid) and then along with January and February leaving March as the last payment (75 remaining).

 

To them come home to find a bailiff letter taking the fee to 370 as apparently it was passed to them in November (they say they have sent a letter but when asked for proof said they couldn't provide the company is marstons).

 

I contacted the bailiff and offered monthly payments, he then refused.

I am also a sufferer from severe mental health which I've provided to the bailiff over WhatsApp (so I've documented proof)

martsons advised me to do this.

he ignored this and just said "370 on Friday tar"

I've spoken to marstons on 4 other occasions with them notifying me that they will contact the bailiff and ask him call the office (on all 4 occasions over 3 days)

 

spoke to a lovely lady today who said nothing from him and she will contact his manager to ring the office and call back in a hour.

Which I did to then be greeted with I need speak bailiff and there's no notes or anything suggesting they promised contact the bailiff and leave voicemails or his manager.

I asked for the calls to be listened into and he said he would try and then call me back.

 

I'm at my wits end as I can't afford it in full with my reduce hours, now at work and me having time off due to mental health.

I have document proof to the bailiff me offering payment plans ect.

 

Marstons just keep saying its nothing to do with them and they cant do anything.

Im not refusing to pay (even though i feel its wrong having already paid the fine nearly off including late payment fees and to not be notifiedd it went back to them in november) HELP!!

I am having difficulty trying to understand your post. From my reading of your question, it would seem that you had a court fine and that the COURT allowed you to repay the debt in monthly instalments. Unfortunately, you defaulted (in November). I am confused by what happened after this.

 

You mention that you then incurred admin and late payment fees and that you paid these charges. Where these charges applied by the court? If so, how much were they? 

 

I am assuming from your post that you continued making payments to the court and that the final payment of £75 was due to be paid in March but that you again defaulted.  After doing so, you received a visit from Marston's and that the amount now owed is £370.  You mention that apparently, the court had passed the case to them when you defaulted on your payment arrangement last November. 

 

You should have received correspondence from Marston's but almost certainly; you should have received correspondence from the court to advise you that your payments made to the court had been FORWARDED to Marston's. Did you receive any correspondence? If not, then you need to call the court and ask them to confirm what address they have recorded for you.

    • i have just this minuet sent them a SAR. hopefully i'll get something from them, but so far they havnt responded to any emails i sent. my ex has already written the letter explaining things for the judge to read when it finally get to court.    shes a decent woman and if i asked her she would come down and go to court with me, in her letter she accepted responsibility i just can't under stand why the water company won't respond ??  feels like i'm going to get shafted here, how it can go from £890 to £3200 in the space of two weeks i don't know, i'm really lost 
    • If the debt is settled within a certain timeframe (ie x days or weeks from date of the order) can the CCJ be removed? 
    • Please give more details about the collection agency. You say that you are able to get something in writing from your ex-partner that you are not responsible. I suggest that you get that immediately. Is your ex-partner prepared to take responsibility for the debt? The jump from £890-£3200 sounds enormous and it sounds to me as if they must've moved this up to the High Court for enforcement. You will get more specialised help soon – but in the meantime send the water company an SAR and get the statement from your ex-partner.  
    • hi. i never actually got any letters from anyone untill i found out about the CCJ then i asked the court for details of who it was from southern water company,  then as soon as i phoned up the collection agency they came around was rude as anything and said they was going to take my stuff.   then told me the bill had gone up from £890 to £3200.  that's when i got a stay at the court, other than that i havnt had any letters at all

    • This is a bit of a lengthy one but I’ll summerise best as possible.
       
      THIS IS HOW THE PHONECALL WENT 
       
      I was contacted by future comms by phone, they stated that they could beat any phone contract I have , (I am a limited company but just myself that needs a business phone and I am the only worker) 
      I told future comms my deal, £110 per month with a phone and a virtual landline, they confirmed that they could beat that, £90 per month with a phone , virtual landline  they also confirmed they would pay Vodafone (previous provider) the termination fee. As I am in business, naturally I was open to making a deal. So we proceeded. 
      Future comms then revealed that the contract would be with PLAN.COM and the airtime would be provided by 02, I instantly told them that this would break the deal as I have poor 02 signal in the house where I live as my partner is on 02 and constantly complaining about bad signal
      the salesman assured me he would send a signal booster box out with the phone so I would have perfect signal.
      so far so good.....
      i then explained this is the only mobile phone I use for business and pleasure, so therefore I didn’t want any disconnection time in the slightest between the switchover from Vodafone to 02
      the salesman then confirmed that the existing phone would only be disconnected once the new phone was switched on.
      so far so good....

    • The FSA has announced large fines against DB UK Bank Limited (trading as DB Mortgages) - DeutscheBank and also against Redstone for their unfair treatment of their customers.

      It is now completely clear that any arrears charges which exceed actual administrative costs are unfair and therefore unlawful.
      Furthemore, irresponsible lending practices are also unfair and unlawful.
      Additionally there are other unfair practices including unarranged counsellor visits - even if they have been attempted.
      You are entitled to refuse counsellor visits and not incur any charges.
      Any charges for counsellor visits must not seek to make profits. The cost of the visits must be passed on to you at cost price.
      We are hearing stories of people being charged for counsellor visits for which there is no evidence that they were even attempted.
      It is clear that some mortgage lenders are trying to cheat you out of your money.
      You should ascertain how much has been taken from you and claim it back. The chances of winning are better than 90%. It is highly likely that the lender will attempt to avoid court action and offer you back your money.
      However, you should ensure that you receive a proper rate of interest and this means that you should be seeking at least restitutionary damages - which would be much higher than the statutory 8%.
      Furthermore, you should assess whether the paying of demands for unlawful excessive charges has also out you further into arrears and if this has caused you further penalties in terms of extra interest or any other prejudice. This should be claimed as well.
      If excessive unlawful charges have resulted in your credit file being affected, then you should take this into account also when working out exactly what you want by way of remedy from the lender.
      You should consult others on these forums when considering any offer.
      You must not make any complaint through the Ombudsman. your time will be wasted, you will wait up to 2 yrs and there will be a minimal 8% award of interest and no account will be taken of any other damage you have suffered.
      You must make your complaint through the County Court for a rapid and effective remedy.
