      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've had to create a new account because (a) I haven't been banned but (b) half my "old persona" won't work - I can post but all attempts to send PM's or get into the Inbox are met with a blank page. Thought it was something to do with me, but no, my "new account" has exactly the same issue and any attempt to load the Inbox or to send a PM to anyone gets me an error message and a blank page. I'm finding the interface very user unfriendly and useless.

I'm sorry you are having such difficulty. It's a big change for all of us.

You have to have made at least 10 posts before you get access to the message system. This is an intent to deal with spammers. On the old system it was set at 30.

I think it will be better if you carried on using your old account and we helped you try and navigate it better. Which is your old account?

But actually, having checked the problem, it seems that we have a global problem with messaging system at the moment. So it's nothing to do with your account. The messaging system seems to be broken. If we can't fix it then we will get Invision to have a look at it as soon as possible.

Okay I fixed it.

It turns out that it was the plug-in which we installed to prevent people sending messages unless they had 10 posts. We definitely want this plug-in installed but I'm going to contact the developer.

Arghh!

 

Thanks. I thought it was me being stupid! And I wasn't doing much to hide my other user name! 

 

Is it possible to merge my old account into this one? I had lost my password anyway, so I was only able to log in on one device that had saved it. So having this new account is useful for me as I can then use it on other devices. My bad for losing my password.

 

PS - just in case it wasn't that obvious - the other account is sangie595!

I think this new site is better the more you use it. Of course it takes getting use to and will be tweaked to improve. 

 

Have gone through so many computer changes personal and work, that I no longer become stressed out, accepting the challenge of learning to navigate the new system.

Yes, it takes some getting used to – and it will be tweaked to improve it as we go along. Some of the old hands here have been using the old platform almost unchanged for more than 13 years so it's a big shift for us.

I'm afraid we didn't have much choice. After 13 years the old site had been heavily modified and when we needed to upgrade it for security purposes, we weren't able to carry the modifications over. We really were faced with making a very difficult choice and eventually we decided to go with Invision – the new platform because it seems to be very well supported and there are lots of modifications around which have helped us already to make it far more usable – but there is still more work to be done.

Hopefully this Invision platform will be good enough to see us over the next 10 years or so.

I like the new layout, sure there will be some quirks, but it runs better and less scrolling past a million tweets at the top of every page.
