      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all, 

 

so long story short

 

I opened a small £100 loan with Mini Credit back in 2013.

Missed the payments as I was also paying back Wonga, Lending stream and Quick quid at the same time so naturally it meant that it climbed up to £691 and only having around £700 a month meant money was hard (I was in part time employment but was only receiving £250 in wages). 

 

forgot about the debt,

saw it on my Noddle credit report but thought it would go away,

all other loans have been paid or written off.

 

I was looking through this forum for advice on Kapama/Opos when I thought about checking my emails as I’d never heard from Opos about my account.

I found a few old emails in an account I never use but opened on dated Dec 2018 stating that my account was being sent back to Kapama as they couldn’t get hold of me.

 

Any idea what that means?

I’m trying to clear my credit report so anything would be helpful.

Hi all, 

 

Firstly apologies for the very late reply. I totally forgot I had posted this until I logged in today to post about the same company. 

So Kapama/Opos Limited have sent me a statement and a signed 'credit agreement' from when i opened the Mini Credit account but the signed credit agreement only has the final sum of £520 that I would have been paying back for the sum of £100 that I had borrowed. 

 

The Kapama statement states the £100 I borrowed, £121 interest charges, £100 debt collection charges, £25 default charge 1, £50 default charge 2, £350 for attempted charges = £746 minus £55 I paid. 

 

does this sound correct to anyone? 

 

I'm not sure what to do about the irresponsible lending. I'm still searching emails for emails from the other debt companies.

get an IRL complaint in to the OC

all those charges are unlawful penalties anyway .

Have a read across the forum about minicredit.  They are easily sorted and just rely on people not knowing their rights or who get scared and pay them something.

None of their charges will ever get through court. In fact, hardly any of the loans actually went to court as they were too scared to let the court see how many bogus charges they were adding.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Sorry for the very late delay, sometimes I post in a panic and then forget I’ve posted at all. 

 

I emailed Kapama/Minicredit for a statement from when I took out the loan, received the letter then haven’t done anything with it as I’ve been busy. 

Today I’ve looked at my credit report as a change was reported on there and realised the Kapama/Mini Credit file has disappeared completely. I haven’t had any letters or emails regarding it. Does anyone think that means I’m going to have bailiffs knocking on my door sometime soon? Or a court date?

I haven’t worked it out, I’m just worried that as it has disappeared from my credit report that might be the next step. 

 

Surely if they were going to remove it from my credit report for any other reason they would have let me know somehow?

where have you got the idea from that a debt being removed from a credit file = bailiffs?????

and

that bailiffs could ever be involved in a consumer credit debt ??

a DCA is NOT A BAILIFF

and have

ZERO legal powers.

 

on consumer debt, bailiffs could only ever be involved after you lose a court case and fail to pay

and even the.. there is no right of forced entry on consumer debt anyway.

 

so did you raise an IRL complaint?

no good just asking for a statement SAR them.

get everything.

 

I would suspect, as this debt stems from around 2013 that you were defaulted around then too

and what has simply happened is the default has reached its 6th birthday

thus the whole account is removed from all files under industry guidelines

but that does mean the debt is dead, nor not owed.

I have been looking through the forum for an answer to my question, I was just reading some of the other Opos/Kapama threads but none had any information on this specific problem. 

 

As I have said I haven’t done anything as I’ve been busy and to be honest totally forgot.

Opus/Kapama ARE minicredit. Same people run it.
