    • Please please help we were miss sold full fibre by EE July 22  Install couldn’t go ahead no equipment sent and no. Survey it was hell  foind out no full fibre in road so we had to go back to cooper no choice we involved. Ceo and they put in a man from customer resolution s  he was vile he told me I had to go to engineers  something very odd about the ex resolution s in bt basically they took my drive up said they Would put ducting in ready for full fibre we have got £ 40 for a hours upon hours phones stress and more told to go to ombudsman  then bill was £35 we called twice told it was that price as they had treated us appalling two weeks later all sky package gets pulled we call again our bill goes to 165 the next two weeks was hell trying to get yo bottom why it’s off our package it was all on in the end I spent a day on the phone  341 mins was the call anyway I got to the bottom it was this resolution man coveting up the other issue another deadlock  to cover it all up  they hide data  ee did so couldn’t get the miss sell in writing I have now only from sept  Basically now we tried getting full fibre and they have found my drive had to be taken up again which has sunk .  The engineer has placed the wrong ducting again under my drive and need s to be taken to again apparently and the pipe sticks up middle of the drive near gate not behind look so odd it’s a big as a drain pipe open to water and it’s below touching the electrical cables to hot tub . I was sent a letter from the ex resolution to say I had stopped the work  I haven’t  it’s so sadistic she covering up for her mate in that team as the orginal install he didn’t check it had been done correctly  I took to Twitter and posted on open reach they ignored me then after 3 calls of two weeks they sent a engineer bt ignored me ceo emails blocked tag on Twitter unanswered then we get someone from twitter send a engineer he written report to say it’s dangerous since we have  had a  letter to say our problem can not be resolved  then a email to say sorry we are leaving and we can’t get into our account Bt will not talk to us ofcom tells us nothing they can do Citzens advice said go to the police  we can’t go back to virgin due so mass issue with them only option is sky  but point is they make out we have canceled we haven’t we have this mess on our drive dangeous work we are in hell  it’s like she covering up for this collegue it’s all very odd I am disabled and they like played mentaly with me open reach say bt resolved the issue no they have not  I recon they have terminated us making our we have  to hide it from mgt  Help it’s hell I don’t sleep we have 29 may we have tried  calling they just ignore me  at first they are so lovely as they say I am then they go to nnamager and say we can’t say anything to you end call  Scared police are rubbish I need help even typing is so painfull  Thankyou  anyone hello be so grateful

Question is, should you be the one to take that role. You are entitled to the £220, if your flight was from the UK. If it was TO the UK I suppose it is more of a grey area... though the airlines I know have been using £220 as standard. Not that surprising for Ryanair, the worst cheapskates in the universe, to go for the lower amount, and if you forward this to the CEO he will probably have a jolly good laugh and give his accountants a verbal bonus. After all he's the one who said and I paraphrase "F*** our customers, they'll fly with us again anyway". While we would all love to see Ryanair get wooped in court again, I have to join my fellow posters in thinking it's not worth the hassle for (hypothetically) £7 and not sure it will expedite the payment either. It's already an achievement that you got them to accept to pay.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi guys,


Hoping you are all well. 

 

Just received a letter for PCN.

My partner was driving at this time.

She was picking up our daughter from a nursery.

 

The location where PCN was issued is within the ground of the nursery.

Unfortunately she over stayed around 18 minutes without paying.

No ticket was attached to the vehicle at the time. 

 

She was advised by the nursery that they do not ticket the car if it's under 10 minutes, however did this time as it was longer.

 

Should we settle the cost of 60 quid?

to be honest you should know what to do by now, you have collected enough of them before and been told just about all of the permutations

 

if it is ticket slapped on the vehicle you do nothing for the moment but next time you are there you photograph the entrance to the land from the public highway and all of the signage in the parking area.

 

If it was the first  letter through the post then it has failed miserably to fulfil any of the requirements of the POFA so no-one owes them a penny

 

I would ask the nursery whether they hve done a DBS check on the bod taking the details as they havent used ANPR as there are no pictures on the NTK.

 

om goggleyes there is no signage other than a small one saying you might be clamped so no contract.

That is from May 2018 so anything newe wont appear on the pictures which is good news for you as you can use the screen shots to cast doubt on their story.

 

also to be picky there isnt a car park on Tollgate rd, it is in Kingsford way

Thanks Eric, I agree with you and I kind of understand it, but I am always paranoid I will do something incorrect and mess  it up... 

 

This is the first letter I received and no ticket was slapped on the car at the time of event.

 

You are right about google, there is no signage on the pictures, however there are 100% signs now inside that parking courtyard.

 

I will stop by the nursery myself next week I take my daughter and speak to the staff.

 

You are also right about car park being on Kingsford Way, should have made it more clearer.

but CEL say it is Tollgate rd.

Now that is the address for the nursery but does that accurately identify the land?

 

This moot point  wont win you the war but show CEL have been slapdash elsewhere and the rest of what they say this is true will carry little weight and small things like this just add to the weight of your arguments.

You are correct, that post code and the address on letter comes up as a main road entrance.

 

The car park is located at the back from the main road that you enter via Kingsford Way.

 

I will drive up there right now to get some pictures and will post shortly.

Hi, please find attached images of the car park and entrance from the road.

 

One thing that I noted is that upon entering the car park the signs on wall are CEL, however inside the actual car park it is from company called StarPark.

 

Please also see ANPR camera in the middle of the car park.

the companies often have this odd arrangement but they are not even run  y the same people but the actual peopel who run them are good frienrds and the peopel named on the Companies House registration are just front men. Totally illegal but no-one polices this so it is more common than it should be.

 

This means that CEL cant enforce on behalf of a third party. This is  somehting they know and tend to go quiet when they sue people and this is raised as part of a defence.

 

also note that the signon the entrance is an "invitation to treat" so that menas you can ignore the other signs anyway. As for only paying by phone- unfair contract.

 

Also if Starpark are the service provider it would be unlawful for CEL to obtain your keeper details from the DVLA as they have no  reasonable cause to do so.

 

You need to write to the DVLA and ask then is Starpark Ltd are permitted automated access under the KADOE agreement and if they are not then you complain that CEL are breaching their agreement because they are working solely for soemone who has no authority to have your details.

 

Get on with this now and when you get a response from the DVLA tell us and we will probably advise a compaint to the ICO.

 

Also ask the local council if anyione has planning permission for the cameras and signage

dont tell the council why you want the info,

they are less likely to want to say anything but be clear they are ANPR cameras as these are different to ordinary CCTV cameras as far as consent goes.

 

DVLA address leed looking up.

 

You ask who and when and what was the reason given. you then ask is Star park have access to the KADOE system as they are 2 separate things

I have sent the letters to both DVLA and Newham Council on 21st of March. It has been almost 2 weeks, but have had no reply. Should I be worried or try and resend again?

give the council a ring and remind them.

the DVLA have a specific office that delas with such requests and they ahve a habit of ignoring all correspondence that arrives at the wrong postcode and this seems to be a ploy to avoid having to both answer your query and produce statistics that show they are abetting unlawful activity

Hoping you all had a great Easter.

 

Update:

Having sent 2x letters to both DVLA and Newham Council I had no response yet.

 

I spoke with Newham Council planning department, they had told me that they are not able to provide any details in regards to the ANPR Camera and it must be put in writing (which I did).

Same with DVLA, but I am getting no responses.

 

Both letters 2nd time were sent as signed for and they had been accepted.

Is there anything else I can do? 

 

I have returned home from being week away and found another letter from CEL that I put aside with other letters for time being. 

 

Any suggestions are appreciated!

I would approach DVLA in 2 stages.

 

Stage 1 - email [email protected] with the request for who, when and why obtained your details. That normally gets a reasonably speedy response. Once you have that response it will determine what stage 2 needs to be.

 

They only have certain procedures listed to follow, so if you include two types of question in one letter it can confuse them as free thinking is not encouraged.

TBH your phrasing of what you want from the council isnt that clear. You need to ask them if planning permission has been granted under the 2007 Act for the signage and cameras at.......

Your version looks like you are vaguely asking for planning permission to put cameras up!

Now with the DVLA you give your personal and vehicle detaisl and ask WHO has accessed your personal data, WHEN and what was the stated reason

DVLA does not recognise them and they are not permitted to get information?

Could this be correct?

WHO HAS ACCESSED MY DATA, WHEN AND WHY. was the first instruction for your letter to the DVLA

 

you have half of the answer though and that is enough to show that whoever did access the system will have unlawfully passed on your details to star park

 

Now you will have to start all over again but this time you show us EXACTLY what you intend to say before you send the letter

You are not new to parking problems so we expect you to pay more attention

Thanks for the reply. I have sent them two separate emails as suggested in previous post. One to ask who has accessed my details and one to ask if StarPark has access to KADOE system records.

 

I have not yet had a reply who has accessed my details.

That is down to them but they are not obliged to consider an email and as they know they are in trouble they will do anything to obfuscate.

 

I really dont undersatnd why people wnat to demand to use email when a proper letter is theonly or best possible method of correspondence.

 

now in your case they may well send the requested information to you via their promised letter because they cant send it in an email as they have no way of verifying any email address

There are two other matters to consider. The general rule with parking companies is that they allow 10 minutes grace. So it seems unfair that here they expect you to pay to park within that period when you have not yet made up your mind to park at all.

The second point is that as they are with BPA then there are two periods of time involved prior to a ticket being issued. The first is the observation period [which is ten minutes minimum] and the second period is the grace period which is not specified but eight minutes over could include things like strapping a young child into  their car seat as well as an allowance for extra time when toddlers are involved.

Thanks Eric, I have already sent 2x separate letters via post. I did not get a reply for over a month, hence the reason for sending emails as suggested.

 

I will wait till end of this week and hope to receive a letter via post. If not I will follow up again with a proper letter via post. 

 

I have just received a letter from Newham Council planning permissions department (See below). I have also searched all the database myself and did not find any licenses or permissions being granted for the specific address.
