Credit Limits International/wardhadaway PAPLOC - Statute Barred Kuwait Bank Cebt

I have just received a pre action protocol letter from Credit Limits International for a 10 year old debit from Kuwait.

Should I return the pap or should I just ignore it?

Hi,

I was working in Kuwait and took out a bank loan,

I had to leave the country due to a change in circumstances,

 

it would have 12- 18 moths ago I started getting emails from a company in the US asking me to pay off the outstanding loan,

I blocked the emails and never heard anything for another 12 months.

 

I started getting letters from Credit Limits which I ignored. 

 

Then at the weekend I received a pre action protocol from Credit Limits.

How old is the debt what date did you take it out ? How long a term ? Have you made payments ? what date was the last payment made

 The loan was taken out over 11years ago and I think it was over 48 months. The last payment would have been made in June or July 2008. I have not received any letters or emails from the bank.

Statute of limitations. The statute of limitations period is five years In Kuwait.

Given that your last payment was July 2008...the debt is now dead.

 

Ignore them.

Debt not enforceable in UK either, just ignore them unless they actually issue a claim. This is extremely unlikely as they have no right to do so as they arent the creditor and they arent lawyers, just some bloke working from a shed in Faversham.

Having heard nothing more CLI I thought that this claim was over and done with,

 

However on 15th November I received a letter from wardhadaway law firm ( Solicitors from Leeds ).

I just ignored this letter as another fishing attempt.

 

This morning I received a “signed for “ letter containing a letter of claim sent in accordance with the Pre-Action Protocol asking for various details and several statement of accounts.

 

What do you think I should do next?

Write to them and tell them that you deny any debt but in any event even if such a debt did exist that it would be unenforceable through the passage of time both under UK law and Kuwaiti law.

Stand by for more contributions from others who might have different ideas

Is there a standard format for the letter? Or do I reply using their paperwork.

I wouldn't bother to use their paperwork. Send your own letter. There is no standard format – but don't try to get pompous or use complicated language. Broadly just use the words so I suggested in my earlier post.

Once again, you are in no hurry so hang on and see what other people have to say

I will guess one of the UAE banks are wardhadaway law's stated client.?

It’s a Kuwaiti Bank which has been named in the letter.

then send wardhadaway law our statut barred letter 

from the debt collection section of our library

 

but adapt in to include

no as I said 

you need to remove ALL ref to it being under uk law and the oft

 

insert the lines I already suggested and the relevant law bit from the Kuwait regulations and whom is the regulator there.
