Hi

The DCA taking me to court - small claims - has supplied their "bundle", and I have found a error in my favour - am I obligated to inform the court before the hearing, or can I keep it secret until the day? I am afraid to inform the DCA in case they correct the error. What do you think?

I don't know what a secret squirrel is.

What difference does it make what topic it concerns?

A knowledgable answer to my question is all I have asked for.

If anyone knows the law could you please advise?

It would depend on if you found it after you submitted your statement and disclosures already or not...if not you would raise it in your statement and challenge the " error ".If you have already exchanged and submitted you could submit a supplemental statement in addition and raise it as new evidence.

 

Whether it would be worthwhile or fatal to the claimants claim without all the details its impossible to advise.

its someone who doesn't give us the information we require to PROPERLY help you

and needlessly keeps things we need to know a secret like a squirrel hiding nuts until its too late to help them

 

there are 1000's of topics here where people have posted the info we require in the link requested twice noe and it never ever hurt anyone..

well we would certainly have had people winging..theres not one case of that here...

 

you'd better move your other nuts soon as the dca I can see is going to win this case.

 that would be de minimis,  and no use to you whatsoever unless they are chasing someone else with the other account number.

More seriously though, why is a dca suing you they are just gophers who dont own the debt. That is more important, if they ahve bought the debt then they are not a dca but the creditor and to buy a debt they ahve to send you notification of the assignment of the debt under the law of property act 1925.

being vague and secretive wont get you any meaningful help. We want to help but asking how long is your piece of string isnt soemthing we can answer.

I am going to suggest somehting that the others are too polite to say.

Eitherco-operate and answer the valid questions or go and bother another forum.
