Particulars of Claim


What is the claim for – the reason they have issued the claim? This claim is for the sum of (circa) £3000 in respect of monies owed under and Agreement with the account no. XXXXXXXXXXXX pursuant to The consumer Credit Act. 1974 (CCA).

The debt was legally assigned by Hoist Portfolio Holding Ltd. ( Ex Barclaycard) to the Claimant and notice has been served. The Defendant has failed to make a contractual payments under the terms of the Agreement. A default notice has been served upon the Defendent pursuant to s.87(1) CCA.

The Claimant claims. 

1.The sum of (circa) £3000

Have you received prior notice of a claim being issued pursuant to paragraph 3 of the PAPDC ( Pre Action Protocol) ? Yes


Have you changed your address since the time at which the debt referred to in the claim was allegedly incurred? Yes


Did you inform the claimant of your change of address? Unsure possibly emailed all debt collection companies when moved on receipt of receiving a letter.


What is the total value of the claim? £3000


Is the claim for - a Bank Account (Overdraft) or credit card or loan or catalogue or mobile phone account? Credit Card - Barclaycard


When did you enter into the original agreement before or after April 2007 ? After 2012


Is the debt showing on your credit reference files (Experian/ Equifax /Etc...) ? Original Barclaycard debt isnt but Hoist Debt is


Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim?  Debt Purchaser I think


Were you aware the account had been assigned – did you receive a Notice of Assignment? Unsure


Did you receive a Default Notice from the original creditor? Unsure


Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? Dont thnk so but cant be certain.


Why did you cease payments? If this debt is mine I ran into financial trouble, I am now a student with 2 kids and no income.


What was the date of your last payment? Unsure - account defaulted on 20/03/2015


Was there a dispute with the original creditor that remains unresolved? No


Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? I contacted stepchange in 2014 and they setup some arrangements at £1 per month. Cancelled standing order in late 2014 early 2015.




I am a little concerned that my debt problems in the past are finally catching up with me just as I maybe getting sorted.


I have a few debts that amount to around £13k mainly loans and credit cards.

I ran into a bit of trouble in 2013 and 2014 and ended up defaulting on a lot of debts. 

Recently I have had someone call to my house regarding another debt


this week I received a claim for another account.

I dont want this to affect my future just as I feel I am getting somewhere, I graduate this year as a Nurse and will have a job around September hopefully. I would then look to get our finances sorted for good, I wouldn't like to end up with a CCJ or a bankruptcy which could possibly affect my career and I have avoided this since 2014/15.


Could you provide me with some advice for the following please?

pop up on the MCOL website detailed on the claimform.
 register as an individual
 note the long gateway number given
 then log in
 select respond to a claim and select the start AOS box.
 then using the details required from the claimform
 defend all
 leave jurisdiction unticked.
 click thru to the end
 confirm and exit MCOL.
 get a CCA Request running to the claimant
 leave the £1PO blank and uncrossed
 get a CPR 31:14 request running to the solicitors [if one is not listed send to the claimant]
type your name ONLY

no need to sign anything
you DO NOT await the return of paperwork.
you MUST file a defence regardless by day 33 from the date on the claimform [1 in the count]


please don't hit Quote...just type we know what we said earlier..


if everyone stopped blindly paying DCA's tomorrow
