      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Next time you try to upload something, flag it to us if there is a problem.

I don't quite understand how you could have used more than double your attachment limit. We still trying to understand some aspects of this platform. We'll get it right eventually.

Okay I've had a look at the files you have uploaded.

You have about hundred and 30 files which you have uploaded this 2016. Most of them – maybe all of them are PDF files. That would be fine except that I've now had a look at some of them and I see that they are PDFs of photographs.

In other words what you have been doing is that you have been photographing documents and then combining those image documents into PDFs. This means that they are extremely large. For instance, I've discovered a document which you uploaded in 2016 which is made up of an 11 page PDF but which is over 7 MB in size. That is huge. The reason that the PDF document is so huge is because instead of having scanned your documents, your photographing them.

I'm very sorry but we simply don't have the capacity to carry this kind of data for people. We probably never made it clear but we expected that when people upload their files in PDF format, they would scan their documents so that the documents would be extremely legible and also take up a minimal amount of space.

You've been uploading documents in PDF format. They are not especially legible and of course they take up a huge amount of space.

I don't know if you have a scanner that for £49 or so you can buy an excellent scanner from PC World which will last you ages. You can then scan documents very quickly into PDF format and upload files in multipage PDF format. This means that the people who look at the documents will be able to read them much more easily and also it won't cause such a heavy burden for us. We have limited server space. We are not able to afford bigger storage.

I'm afraid that in view of that I don't think I can do much to increase your file storage limit. I'm gonna have to ask you to start managing your files by going through what you've uploaded and deleting stuff. I can imagine that many – maybe all of the files that were uploaded in 2016 and 2017 are no longer needed. The files are personal to you – in other words they probably aren't of a general value to the rest of the community so they may as well go.

After that, I would really ask you to review your practice in terms of uploading documents. Please get yourself a scanner. You can get a very good cannon scanner for about 49 quid – or even better one for about 60 quid from PC World. It will make life much easier for you and for the people on this forum who want to help you. It will reduce the load on our limited storage. And you will have the scanner available for all the other things that you might want to do for many years.

Or just use an online converter and lower the quality. Theyll be a few hundred kb at most then. In PDF format

Just a quick note to say that I also now understand how come you've exceeded your storage limit so dramatically.

We've obviously carried over your uploaded documents from the old platform onto the new one and from our old server onto the new one.

Yobs he had a lot of documents which fell within the limits set on the old setup but are now beyond the limits on the new system. We haven't deleted anything – but now I'm afraid that we have to be a little bit more careful about the way we upload and store material

That is one solution but of course a better solution will be to scan rather than use photographs. The solution you are suggesting will not deal with the readable quality of photographs – which don't tend to be very great. Sometimes out of focus. Sometimes not entirely centred or squared. Sometimes pretty dark.

They help and advice we give here is completely free. However, I don't think it's unreasonable to expect people to invest 49 quid in a scanner simply to help themselves – and also to help the other people who want to help them.

I think I have already replied to this on another of your posts cruz...go to your profile top right ...drop down ...My Attachments.....you have to put a tick on th uploads you wish to delete....obviously the very old uploads.

We could do with some help from you.

I just find it easier hosting the pics on an external site and linking them here.  Although i see how that could fail given that new members cant post full links.

Apparantly the check box to delete is not showing on some users screens BF....not sure if this is down to type of browser they use or screen config size or layout.

We could do with some help from you.

Yes the bulk delete facility on this platform is really not great. I have seen it referred to on the Invision website as well.

I can do some bulk deleting in the admin console – if cruz says that is okay.

Okay everything for 2016 and 2017 is deleted. Tell us what that does.

Do I take it that you are about to upload more PDFs containing photographs?

Yes, but when you have been converting your photos to PDFs, they are still basically JPEG's – images. That is what causing the problem. If you are photographing documents then you should get yourself an android or an Apple app which effectively scans them so that they become a document file rather than an image file. Then they will only take up a very fraction of the space.
