Got the following in response to the lba from Stroud & Swindon:

 

"The mortgage was not regulated under the Consumer Credit Act 1974 and completed prior to FSA Mortgage Regulation which occurred on 31 October 2004"

 

 

I guess they're right but it doesn't alter my case? I assume though that I should remove reference to the CCA in my claim?

There response is correct, however the consumer and contract legislation involved with these claims is still relevant.

 

So does that mean I should leave in references to CCA in my particulars? Need to get the claim in tonight.

Hi we had a mortgage with Stroud & Swindon and when we changed companies we paid over £5k in ERC's are we likly to get any back or are they as stubborn as the rest !! we changed our mortgage over 2ys ago.

any ideas

statements requested 23rd Nov charged £5

statements arrived 28th Nov

sent first letter claiming £1264 on 7th Dec to halifax

halifax replied standard letter 13th Dec

second letter sent 22nd Dec :p

Halifax sent letter 22nd Dec offering £1087 full & final only £177 short of the full amount:eek:

Accepted the offer on 28th Dec on to the next one.......
