I've queried my entry on my credit file with Experian - as NW had said they'll amend the date entry and ask Cabot to do the same

The Cabot entry hasn't been amended

Experian has just got back to me with the following:

I'm sure that's not right though? Thanks

*Nat West Credit Cards (Account started 02/07/2009)
*Cabot Credit Management Group Limited (Account started 02/07/2009)

The entry recorded by Nat West Credit Cards shows the name of the company that the debt was originally owed to. The second entry recorded by Cabot Credit Management Group Limited shows that the debt has now been sold to another company to collect.

Although the debt is now being recorded twice, only the entry recorded by Cabot Credit Management Group Limited will be considered when you apply for credit, or in the calculation of your Experian Credit Score. No further updates will take place on the original debt.

Both entries will show on your Experian Credit Report for six years from the date that the account defaulted.

the first bit is correct

as long as the cabot entry now shows the CORRECT defaulted date [same as the NW entry] then everything is ok

if not

take a copy of the corrected NW date on the CRA file

send that to cabot

with a covering letter giving them 14 days to correct their entry

else you'll start a serious complaint with the ICO and wil be seeking financial compensation

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

  • 4 weeks later...

Afternoon,

Cabot has (finally) amended the default date

However (as suspected) they've entered the date as October 2014

This does not match NW's entry which is October 2013

Interesting as both say that they are not in contact with each other, and Cabot entered Oct 2014 - which is the date in my letter from NW originally

Can I enforce Cabot to change it? As the default date should be the same as the OG?

Thanks

 Ah, I hadn't said that

However, I cannot log a complaint with the ICO at the mo. Even though I gave Cabot 14 days to correct. When I go to file a complaint, as its been less than 28 days. They states I've got to give them 28 days before I can file

shame you didn't follow the advice

that's why they have not replied

so send the worded letter as you were told to above

which gives them a clear deadline and the consequences.

Just checking what I sent on 16/05/19 to them

Failure to amend with the requested time period will result in Court proceedings being actioned

The ICO and Financial Ombudsman notified and compensation sought if Cabot fail to do so

I've mentioned complaining to the ICO. Still re-send as I said will result in 'Court proceedings being actioned' in the first instance?

not sure where we advised to add all the other twaddle.

start again properly.

and don't forget to inc a copy of the evidence from the OC's defaulted date...

Natwest Mastercard A/C no. [16 digits]

Cabot ref number...

Incorrect defaulted date registered by cabot on my credit file.

to whom it may concern..

please find attached proof from the original creditor showing their defaulted date

your entry on my credit file is incorrect.

I give you 14 days from the date of this letter to correct your error.

Should you fail to remedy your error, a serious complaint will be registered with the ICO and financial compensation will be sought for the damage done to my credit reputation by your error.

no further communication will be issued before this is done

*Resolved*

Re-wrote Cabot, generic response but no resolve so had to take my complaint to the ICO

Due to how busy they were they gave me a timescale of September for just someone to be assigned my case.

Eventually had to log a complaint with them about them! As the timescale went on way to long and I could never get hold of my assigned case officer.

Was eventually passed to a senior who took it on and called me to apologise and advised that Cabot will be written to for an explanation.

About 2wks ago got an email from the ICO to say that Cabot made an error and will be putting the data errors right.

Returned from holiday to find a letter from Cabot with a £100 comp cheque, corrected the default date, closed the NW CC account, deleted the default entry.

The NatWest entry had fallen off my credit file months ago, so now the Cabot one is finally gone too!

Thanks dx for the advice followed 😀
