they might change trading name and claim the old Co. no longer exists so no assets to claim against ..

I will guess that you issued a claim against a retailer? for a mobile phone account that was taken out in your name that you knew nothing about until you got a debt letter from them saying you owed them money.

 

subsequently, and that retailer has sold your debt on to a DCA as they do.

 

this will not effect your claim at all no.

 

but ofcourse that doesn't stop you getting a claimform fron the DCA regarding it.

 

pers I think you've gone about this the wrong way

issuing a small claim yourself against the retailer just because you think they did something fraudulent by allowing someone to use your details? [i will guess?] is not the way to resolver this IMHO.

Fancy explaining more on why its gone to court?

 

They charged 6 months further rental despite receiving and acknowledging the cancellation request in writing

 

My question still remains as - how can a retailer sell a debt on despite a court date being set... so who’s going to defend ... the tel com company or debt recovery agency ?

False account is wrong wording ... it was mine but they failed to cancel the account despite receiving and acknowledging the request in writing and took 6 months further line rental which I told my bank to reverse the DD charges

 

It’s in a right pickle but can someone actually tell me if a company can sell the “debt” on if a court has set a hearing date

you still sue them

but however, issuing a court claim is the wrong way to go about this

 

what are you actually suing them for?

you got the moneyback under the dd guarantee?

Telco company.

But make references in Witness Statements that the debt has now been sold - Who too and also what References.

It could work in your favour to a degree...

 

This may be frowned upon but I would advise the DCA that the account is subject to legal action. But it might not be prudent to keep it stum until you know what the deal is...

However I would like to know - Who is the Telco and also what they have done...
