Hi all i starting a claim for the unfair charges incurred by me from my bank,

 

one question i have is how far back can i claim ??

 

on my letter i put 1998 but im not sure.....

You are limmited to 6 years by the statute of limmitations, I think.

 

There has been some discussion as to whether you can go back further but I'd try for 6 years and then go back further if it turns out we can.

Hello and Welcome!

 

You can ask for bank charges using the DPA letter, as far back as you like!

 

However under the Statute of Limitations you can only claim back 6 years.

Personally I have always written direct to my own branch.

 

They were who I opened the account with, they can know I am not happy. Ultimately it will be dealt with by a 'special' unit, but I like to create more work for them all.

Hi they did that with me to.I went online and took screen prints of they ones that were missing added them to the staments that they sent to me. They missed out the statements with the most charges on

You're almost correct there. In terms of bank accounts you can claim back:

 

Unauthorised Overdraft Excess Fee

Returned d/d fee

Returned cheque fee

Overdraft Interest which the overdraft is comprised of penalty fees

whats this mean only claim it back if there is an overdraft excess fee?

Say for example an overdraft excess fee sent you in to the red, and you got charged interest on that overdraft - you could claim both the excess fee back, and the interest you got charged on it.

 

To be honest, doing so is more of a pain than it's worth in most cases. There is a spreadsheet available in the templates library which Vampiress has made available, but be prepared for a lot of work for little return if you are wanting to do so.

hey mate thanks yeh i just looked at the spread sheet while reading your message the most ive been charge interest wise is only £1.01 and the total is less that £10 so i aint gonna bother looking through to see if i was in red

 

especially as the didnt send my full DPA requested

Got to admit, I'm not so sure on that one. Did you have and were you within an authorised overdraft limit at the time? If yes, I'd say no you can't claim it - as it's a payment for using their overdraft service. Although, there is again the argument that it may fall under the UTCCRs... maybe a mod can comment?

 

 

If not in an authorised overdraft, it would certainly fall under the 'overdraft excess fee' category.

hi alll just informed my mother about this and when looking on the online bank she have nearly £200 worth of charges for 2 months
