Hi all just a Quick update and confidence booster for anyone trying to" fry" EGG.

 

They have just settled out of court just before allocation Q's due in.

 

Did all the usual stuff and then MCOL'd them.

Got a letter offering me a refund of £4 per charge .

 

I thought I would ring and counter offer as claims at the court are getting a bit bogged down .(I have one that has been stuck for 2 months @ Leeds courts).

 

I decided to counter offer at 75% plus costs and interest and they agreed.The difference to me was about £40 less than the full claim.

 

I have bigger fish to fry and my worry was that I would have too many cases all bundled together which is what Leeds CC are planning to do.

 

Anyway to my surprise they accepted via phone call later the same day after Legal had been consulted.

 

Just signed and posted acceptance letter .Strangely enough no WITHOUT PREJUDICE written on the top of the letter.

 

EGG NOT SO HARD AS WE THINK.

Thanks both of you........I'm looking forward to spending the cash on Christmas ,instead of using the PLASTIC.

I think sometimes it's wise to take a compromise with regards to settlements.After all you can get over greedy and focus too much on the bottom line.GREEED and FEAR can become the controling emotions on this sort of matter.

Still battle won ........war still raging.

Just spoken to Leeds court and apparantly there are over 100 cases all bundled together (3 of them mine) and increasing daily, all ready to go to the Mercantile court.It seems as though any bank charge case is not being given a court date or allocation.If they go to Mercantile court then it's on the MULTITRACK.One of my cases has been in for 2 months already.
