    • I've just seen your new post. A letter before action is the same as a letter of claim. You don't need a template. You simply need to inform the garage that the vehicle you bought has developed X defect, Y defect, Z defect. He has already been informed of them and given an opportunity to repair and he has either refused the chance to repair or else he has attempted the repair and it has failed – whichever is the case and so under the consumer rights act you are asserting your right to reject the vehicle and you want him to make the appropriate arrangements to collect the vehicle and to refund you the purchase price – plus any associated losses – and if he does not do so within 14 days then you will sue him in the County Court and without any further notice. Don't make this threat if you're not serious about going ahead with it. On day 15 issue the papers. In the intervening 14 days register with money claim and start preparing your particulars of claim. You can post them here if you want us to check them. Whatever you do, on day 15 you send them the good news
    • Well done Shelley. I'll amend your thread title.   HB
    • I'm afraid that your story is rather overlong. It would have been easier to understand it all if there had been less of a narrative and more of a bullet pointed chronology of facts. Although you informed the dealer within 30 days that there was a problem, the Consumer Rights Act requires that there be a clear and unambiguous assertion of your short-term right to reject the vehicle. It doesn't appear to me that you have done this. This isn't a problem at all because you are still well within six months. I understand that you have given them an opportunity to repair and that you have now rejected the vehicle. This is enough to trigger your rights under the Consumer Rights Act as long as the defects which you are complaining about are sufficient to render the vehicle as less than satisfactory quality. As I say, I haven't read through the detail of your story and I certainly haven't looked at all of the PDFs that you have apparently uploaded but I get the impression that you have been quite meticulous in keeping records. I've looked at the Google reviews of Elite and I have to say it doesn't bode very well. https://www.google.com/search?q=Elite+Preowned+Vehicles&rlz=1C1CHBF_en-GBGB822GB822&oq=Elite+Preowned+Vehicles&aqs=chrome..69i57j0l2j69i60j69i61l2.575j0j7&sourceid=chrome&ie=UTF-8#lrd=0x47d8aa4f43f644d7:0x8e93221101489523,1,,,  There is no trust pilot page for them as yet. Maybe you would like to attend to that. You say that the dealer is fond of using social media so that kind of thing is important. Site team member@dx100uk has already suggested that you issue a letter of claim and that certainly seems the way to go although if you are driven to actually mount a claim and presented in court that I hope you won't mind me suggesting that you need to stop being a little bit more economical about the way you present your case. Just in case there is any debate over the defects which have been discovered and their significance then if you haven't done this already, you should make sure that you have got assessments and even quotations for the work from independent garages.
    • Hello dx100uk. Thanks for your attention and help with this. You had an even later night than me! I clicked on the 'letter before action' link which you kindly gave me. This took me to BankFodder's post 'Small Claims actions in the County Court FAQ - work in progress' which I have read through and also the 'Pre-Action Protocol' and 'Letter of Claim' links. I couldn't find reference to a Letter Before Action or is this the same as a Letter Of Claim? Also, my rejection letter already mentioned a 14 day period (taking us to 05/08/2019) for him to get back to me. Is it ok to send a Letter Before Action now? I only ask as I wouldn't want this to be viewed dimly by the court if it goes that far. I do understand that I need to take action as soon as possible so these are just a few clarification questions. I shall google for some Letter Before Action Templates and put something together. Thanks again.

How populist are you

I've done it.

Results as I expected although a few mates think I cheated. I didn't - I think thats more a comment on their perception of their politics. (They think they are centrist - THEY aren't.)

You're most similar to:

AMLO

Mexican president

Andrés Manuel López Obrador was elected earlier this year on pledges to fight corruption, moderate the 'war' on drugs, and champion 'the forgotten people'.

You're least similar to:

Donald Trump

US president

Donald Trump is the president of the US. He has repeatedly failed to condemn radical rightwing activists, and for a time employed Steve Bannon on his presidential team.

It must be a relief that you're not like Trump. :D

I read in one of the articles about an ex-White Houser's [can't remember which one] book that they spent a while teaching Trump to say populist - he kept saying 'I'm a popularist'.

Enjoyable break,lets see the results.

You're most similar to:

Barack Obama

Former US president

Barack Obama was the first person of colour to serve as president of the US, over two terms between 2008 and 2016. Although mostly moderate in rhetoric, he pushed hard for healthcare for poorer Americans.

You're least similar to:

Donald Trump thank goodness for that.

I think a term ending in artist is more appropriate than arist for trump.

I tried it a few times with very slightly different answers as I wasn't entirely sure how to class a few

A bit further up or down but pretty much the same overall slight upper-leftiness

all stayed in the right half of the lower right quarter of the upper left quadrant.

Just left and up of center.

:-D

Mind you trump would report on that as

'Top world reviewer says I am a great artist .... he said as good as pee-casso'

As i recall towards the middle, just about centre.,perhaps a touch higher but not much.Slightly left.Has this some strange meaning. It would not surprise me.:|

Just read what i wrote again as clear as mud, as usual,ha.

Only one thing for it do it again.

See what happens.

You're most similar to:

Evo Morales

Bolivian president

Evo Morales has been president of Bolivia since 2006. He has successfully sought an end to term limits, champions indigenous rights - he is an Aymara - and pursued a policy of partial nationalisation.

heh heh heh

The pays good while it lasts though.

I managed to get further to the right than trump by simply putting in what I thought was obnoxious responses, but failed to get above his 'populartist' standing.

I admit defeat there (for now) as I'm already stating massive lies to get that far on the right..

I think it might give an insight into his mind to work out the responses that these psychologists believe generates a trump (oops pardon me), although a life of unearned privilege generating the childish psychopathy undoubtedly played a major part.

Might give that a try. (which, I here some mutter :-) )

It turns out I am like Emmanuel macron.

That is good because I AM Emmanuel Macron.

Funny how the results of a quiz in a left leaning paper produce results that are mostly to the left. Statisticians all over the world are now looking to see if bears are currently ****ting in the woods.

Funny how you come to that conclusion based on literally a small handful of responses from people who are easily seen as liberal/left leaning. So hence actually supporting its validity ...

... Especially as my follow on tests show its quite possible to come out as even more wrong (err right leaning) than trump, which seems to dash your clearly premature hypothesis.

Whats up? Get a 'Trump thinks you really really grate' result and ashamed to admit it?

Statisticians all over the world are now looking to see if you are a member of their club, and hoping they will only find a few bears doing their business.

You got a 'Nigel wants you to get him a beer' result and misread it as 'bear', didn't you?

He actually is in there just below and a twinky claw to the left of trump

No, I was actually disappointed to be outed as Macron as my general beliefs are quite libertarian in many areas like gun control ( keep sights aligned and dont try and anticipate recoil, just apply pressure to the trigger and let it take you by surprise) and free trade ( but proper free trade not that pushed by multinationals that crush anyone who dont want their goods in the first place).

I was just noting that like most questionnaires there is an inbuilt bias so putting all of the little grey dots on their graph so you can see how others have come out is rather meaningless as it does only state the bleedin obvious and even the idea of how politics is divided up into the left/right authoritarian/liberal axes is at least 30 years out of date.

When Farage was at school he was teased by his schoolmates singing the XTC song we're only making plans for Nigel and that has impacted upon his entire life. it is alright for the bullies now they are head of investment banks and the like but poor Nige never got over it

It actually appears to be left right and populist/non populist whatever they are, and it was quite an eye opener for me that I was anywhere approaching half way up the top half.

Made me think.

Good job they couldn't see the future, it probably would have been a lot worse.

Good to hear though ...

Perhaps goes some way to explain who he is and what he does - not that its an excuse.
