    • Massive issues from Scottish Power I wonder if someone could advise next steps. Tennant moved out I changed the electric into my name I was out the country at the time so I hadn't been to the flat. During sign up process they tried to hijack my gas supply as well which I made it clear I didn't want duel fuel from them but they still went ahead with it. Phoned them up again. a few days later telling them to make sure they stopped it but they said too late ? had to get my current supplier to cancel it. Paid £50 online to ensure there was money covering standing charges etc eventually got to the flat no power. Phoned Scottish Power 40 minutes to get through they state I have a pay as you go meter and that they had set me up on a credit account so they need to send an engineer out which they will pass my details onto. Phone called from engineer asking questions , found out the float is vacant so not an emergency so I have to speak to Scottish Power again. Spoke with the original person from Scottish Power who admitted a mistake (I had told her it was vacant) and now states that it will take 4 weeks to get an appointment but if I want to raise a complaint they will contact me in 48 hours and it will be looked at quicker. Raised a complaint , complaints emailed me within 24 hours to say it will take 7 days till he speaks with me. All I want is power in the property would I be better switching over to EON who supply the gas surely they could sort it out quicker? One thing is for sure I will never bother with Scottish Power ever again.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I know this is slightly off topic. Aquind, a power company owned by  Ukranian who has donated £1m+ to the Tories, is meeting resistance in Normandy and Portsmouth over its proposed cable under the sea.

 

They want it to run through populated areas and beauty spots.

Not aware of the necessities of the routing, or the politics with France threatening to cut power supplies to the Uk,

but I'm aware of a lot of 'green' resistance to any tidal barrier generation and wind farms (for all sorts of environmental reasons) as well as nuclear ..

 

.. I assume they want to return to wood burners? - which are 5-20 times less environmentally 'friendly than gas fires ..

 

Its a difficult set of scenarios

 

Has the person in question also donated/bribed/whatever on the French side HB?

what are the calculated REAL benefits and route options anyone?

Well the regions at both ends have objected - as they would - everyones in favour until its their own backyard

.. and the company is mired in the Panama papers and populist cronyism - but many company directors are

 

..  but it does seem the cost/benefit case for the cable needs to be watertight and outstandingly credible IMO - and not like many of the nuclear proposals where the projected costs are astronomical, and the benefits very limited (as defined) and VERY far in the future

 

First port of call for me would be - is it cheaper than more local solar farms/wind farms (which would no doubtr also raise objections), and would building hydrogen generation/storage/power stations nearer existing wind farms be a better option?

.. and far more 'sovereign'

Looks like Johnson the incompetent liar is trying to line up a few pledges kicked into the 2050 long grass in cop26 as a 'success'

 

Anything which isnt a solid and significant commitment for 2030 is not just a failure, its consigning the whole world to catastrophic climate change.

 

Those who have read and believe the claims that the UK being an island will be buffered better than most to the changes already occurring, are frankly stupid wishful thinkers

The only places likely to lose less are those where land and sea routes is being freed from the Ice - with Russia being the biggest beneficiary of that, and probably China. - although it may be many decades before the land is truely useful for other than more resource mining and military bases

I forget where I read it but someone has done projections of the UK's emissions if trade with the EU is replaced with longer routes to places like the anglosphere. It's logical. :classic_sad:

 

ETA: I'll have a look for the increased emissions figure, it was huge.

Yes, that ties up with all the big container ships now unloading at EU ports rather than UK ports which they used to unload at.

I'd even be 'comfortable with that if they were making any real commitments, rather than rattling on about the 'improvements' they have made, ... which are actually mostly down to accounting practices claiming carbon 'offsets' that were already there or which aren't real offsets, and in reality just kicking any real action down the road to 2050 - actually beyond 2050

India has announced it aspires to carbon neutrality in about 50 years or so, presumably provided nothing happens in the next 50 years to change their minds, and provided something happens to actually deliver that (preferably with nothing required of the Indian government)

and provided they consider at the time that something mentioned generations before should be considered ..

... and of course - if there is still an 'India' in 50 years or so

 

Biden of course has come straight to COP from his efforts to get the oil producing countries to ... produce more oil to address the current 'shortages'

 

- Johnson demonstrably isnt the only tosspot there, although he's probably still the biggest (tosspot)

A number of governments have stated they aspire to reduce and maybe even turn around the deforestation of the planet, and maybe even start to turn it around a bit by 2030ish maybe

Its understood that hundreds of trees will be planted across the world to ensure this isnt an outright lie.

 

In the meantime, Johnson will be taking advantage of the reduction in Taxes on short flights and booze and will be flown back from COP in a private plane with a well stocked bar

A coalition of 18 countries, plus dozens of banks and other institutions, will pledge to phase out coal-fired power plants domestically and to end funding for international coal projects. The burning of coal is the single greatest contributor to climate change, and ending support for it has been a key focus at the U.N. climate change conference COP26.

 

The new campaign, which is expected to be announced by British officials today in Glasgow, declares that the end of coal “is in sight” because of the new coalition. The group will commit to ending all investment in new coal power generation domestically and internationally. The time frame was not specified.
