I'm claiming from a closed account.

19.10.06 sent my SAR with £10 cheque.

25.10.06 received letter that they were unable to locate my account!

26.10.06 - spoke to a James Doherty and he traced the account and would sent on my statements.

26.10.06 - letter stating, 'thank you for your letter dated 26.10.06 (yes it seems they've got their dates wrong!!) and are currently investigating my complaint.

30.10.06 - returning my cheque, unable to process payment as a valid account number had been quoted (which it had!!)

15.11.06 - sent me the following:

We refer to your recent correspondence concerning default fees on your account. I would like to clarify the situation from our perspective.

They go on about explaining about the late payments, and their view that the charges are valid.

It seems that this is a standard letter and they're offering me £170.00.

What they've also sent with this letter is a list of my account transactions which my charges amount to £400! Together with a DPA request slip!!!:rolleyes:


Any ideas on how to respond? Shall I just go ahead and submit an MCOL claim or a LBA?:confused:

After my last post.......a day after sending my prem, I received the 'goodwill' cheque from MBNA! In the first paragraph of my letter I enclosed the following:

I am in receipt of your letter dated 15.11.06. If you wish to send me a cheque for £170.00 then please be aware I cannot accept the terms the attached to this offer. Please also be aware I will take action to recover the remaining £180.00 within the timescales outlined below. If you choose not to send your cheque then I will be taking action to recover the full amount.

Will it be ok for me to bank this cheque or shall I wait for any further responses?:confused:

Was their letter in response to your prelim? IF so u can put something like this at the top of your LBA.


Thankyou for your letter date: xxxx i accept your offer of a refund of charges totalling xxxxx on the understanding as a partial settlement towards my claim. I intend to continue with my claim against you for the remainder of the charges added to my account between the dates xxxx and xxxx.


Dont forget to claim contractual interest.
