    • I purchased a bathroom tap for £125 from online company, 'QS SUPPLIES', in May 2020. It was duly fitted and all was fine until December 2020 when the top lever came away from the base of the tap rendering it useless. I immediately contacted QS SUPPLIES using their online complaints procedure and submitted a photo, as required. When after a few days I had heard nothing from them I called their CUSTOMER SERVICES team and was told that they were waiting for a response from the manufacturer, a company called 'SANEUX', I pointed out that my contract was not with the manufacturer and that I expected QS SUPPLIES to deal with my complaint. I was then advised to email them again, which I did...twice.... when they finally responded to my second email they asked me to send another photo of the faulty tap. This time, their response was that their,  TECHNICAL TEAM had looked at the photo and decided that the tap, "APPEARED TO BE FORCED", and therefore they would be, "UNABLE TO OFFER A REFUND ON THIS OCCASION".  So after  7 months of use and at a cost of £125, this company, on the strength of one slightly grainy photo have decided I am entitled to nothing. I have applied to be reimbursed by my credit card company under Section 75 but I am still determined to attempt to get QS SUPPLIES to take responsibility and would really appreciate any advice about the best way to go about this.

    • Hi Everyone,  I am the seller in this case and want to thank the buyer for their support.  The bike was delivered to the local Hermes Parcel Shop really well packaged and sealed on the 3rd Feb with a receipt obtained.  Sadly the parcel was emptied on route to the buyer.   I had listed the bike for collection only however the buyer messaged and asked if we could arrange a courier to which I agreed and they organised that.  When the bike went missing I contacted the local police as the Hermes parcel shop said they would not release CCTV to me.  We got all this from the Police.  since then the buyer has tried his very best which I am grateful with Hermes and parcel2go but is struggling.  Any help is appreciated.

      Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
      So I issued the claim on day 15 and they requested more time to respond.
      They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
       
      I opted for mediation, and it played out very similarly to other people's experiences.
       
      In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them. 
       
      In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
       
      In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
       
      To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
       
      So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.

appeal lodged late due to NoR arriving late - charge certificate issued - what to do?

am a newbie to this wonder if someone can help me

 

ive been fighting a PCN with harrow council since last year, had my informal appeal rejected and then was sent a NTO ages ago where I restated the appeal and didn't hear back, until a few days ago when I received a rejection letter dated in june which meant I was already out of time to appeal in 28 days.

 

 

 

the reason for the lateness seems to be that they thought my company name was my surname and spelt it wrong, so the address was a generic campus/site address and therefore must have gone into a pool before it was redirected to my specific pigeon hole (please note the address is correct with the dvla - its just the council that have made the error). so in a massive panic, I lodged an appeal online with the reference number given and stated that the reason I was appealing late is that I didn't receive the rejection paperwork until now due to this error in address.

 

 

 

However, ive looked up the pcn online and it looks like it may have already progressed to charge certificate (just because of the price) but I ahvent received this either -maybe this will also come late if they have made the same mistake with the address as with the NoR.

 

 

 

the question is was it the right think to do to lodge an appeal late (the website says you can appeal late if u state a valid reason and I thought not receiving the NoR was a valid reason but I may be wrong) but now im thinking maybe I shouldn't have done that and should have just waited for the next stage to file a witness statement from what I read on here? however the problem I have now is not that I never received the NoR but I received it too late because of the councils mistake in my name/address.

 

 

 

So if this does progress what box can I tick and also ho long will the tribunal take to get a result - am worried that the council will continue to progress the charge while im waiting for the appeal result. help please!!!!!

Firstly, what was the PCN for? Was it parking?

 

Secondly, why is there such an extraordinarily long timescale? Usually the period between the PCN being issued and a Charge Certificate is at most, maybe three months. What else has been happening since last year?

 

As regards the address, the Council should have applied to DVLA for keeper details and are obliged to send the NTO to that name and address. Any subsequent letters/notices must also go there. So is the Council using contact details at variance with DVLA's records?

 

Following a Notice of Rejection, you cannot lodge another appeal with the Council. The Notice of Rejection should have spelled out your options at that stage. If you can answer the above, I will try to advise further.
