Tomlin Order...debt Assigned to Cabot

About four years ago had an N1 claim from DLC just short of the limitations period so stuffed. Agreed on a Tomlin order which has been paying with no issues and no CCJ.

 

 

Get a letter this morning from Cabot saying they now own the account and to make payments to them. Seems they took over DLC and putting DLC into hibernation. Cabot has the previous creditor down not DLC, but ME III Ltd???.

 

 

 

My question is as follows, can they do that being sealed by the court

 

 

1. My Tomlim order is sealed between myself, DLC and the court as a legal contract

2. Has Cabot the legal authority to change the terms of that tomlin Order

3. Do I continue to make payment to DLC by standing order or change to Cabot

2. Has Cabot the legal authority to change the terms of that tomlin See above..terms can be changes as long as you agree and they get it resealed

3. Do I continue to make payment to DLC by standing order or change to Cabot. Change to Cabot..I assume they have provided a Notice of Assignment ?

The only correspondents received is a letter this morning from Cabot. No notice of assignment has ever been received. This Tomlin order was sealed before Cabot took over DLC

 

 

 

It states the account managed by DLC has been transferred to Cabot and managed by them in future. It further states am to cancel my standing order to DLC and use the new Cabot payment details

No, mentions nothing about assignment, legal owner, law of property etc

 

 

It just says your account has a new home

Well DLC is now part of Cabot so I have no reason not to doubt it.
