ANY ADVICE PLEASE

 

received parking ticket sept 2012 from vcs liverpool

didn't admit liability

ignored all letters from bwlegal ,

 

looks like they have now passed it to dcbl firm from can't pay take it away 6 years later

 

any advice

pls I've requested all evidence and proof of contract of landowner,

anyone else received a letter

I received parking/ stopping fine in 2012 (at little roundabout for 20 seconds) which i have ignored all phone calls and threatening letters about ever since. (BW legal)

 

 

This week , July 2018 i received a letter from DCBL ( from can't pay take it away fame )

 

.i rang them up as was unsure what the fine was about .

..and they have taken over the debt from BW legal.

 

..has anyone else received this letter for a historical parking / stopping offence

 

Having spoken to DCBL i asked them to provide evidence of my offence and evidence of who the landowner was at the time of the alleged offence ..

 

..they said they will contact the client to get the evidence and threatened ccj if fine was not paid ..

 

any advice out there on whether or not I should be OK to keep ignoring the LETTERS and are they still unlikely to be able to pursue this through the courts

why did you phone them. You should just ignore them. totally.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Can you remember when in 2012 (roughly will do) you got the original ticket?

 

All the usual "threats" aside, I can't imagine that anyone will actually be taking this in to a court room, as VCS don't actually have any right to issue a private parking ticket (to the keeper) on the airport roads, and to be honest, it's pretty sketchy on the car parks too :lol:

OK, so strictly speaking, they're within time to issue a court claim (they have 6 years) but I can't see it happening as it would be so easy to fully defend. VCS have lost before now at LJLA (and more than once) because it's not "relevant land" for the purposes of the POFA as it's covered by its own byelaws. So there is no keeper liability under POFA.

 

They've got nowhere to go with this.

i think i will take my chance and continue ignoring them

..i wasn't sure if the new company who had taken over were likely to be a bit more proactive.

DCBL will threaten you more, but they have no more power to demand your money than I do.

 

That'll be £150 please :lol:

One point...IT IS NOT A FINE

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

If you do get a claimform don't ignore it come straight back here for advice. They have no locus standi to issue diddly squat so are easily defeated if they are daft enough to risk another spanking in court.

there are more reasons than have been mentioned here as to why any claim they try on will fail but you MUST NOT COMMUNICATE with these bandits any further.

 

They have no claim,

they have no rights

but the more you say the greater likelihood of tripping yourself up and making it harder for yourself.

 

They know it is all lies so that is why they have got DCBL involved because the muppets appear on the telly taking stuff from people and they rely on that to make you think that it could happen to you when it cant.

 

As already said,

they have no more rights to demand anything than next doors cat

so if they do write again send them some cat biscuits and let then know that the neighbours cat is dealing with the matter.

Sending them cat biscuits now?

Back about 8 or 9 years ago when DCAs for the banks were terrorising the bank customers, one of our members then used to ring them up pleading poverty and offer to repay the debt in bumble bees.

 

It was a very funny thread that helped a lot of our members get over their fear of dealing with debt collectors and their threats.
