i have, but i just feel hes gonna agree, every one of these ive done has been rejected at adjudicator level anyway. dont feel like im getting anywhere.

 

right lets assume ombudsman agrees with adjudicator - what do i do?

IMHO theres nothing you can do

paying it will not remove the status

 

that's a true reflection of how you operated the account.

Right sorry I’m just clarifying what you are saying cus it doesn’t really make sense to me. You’re advising never pay it off and just leave it on my credit report for eternity?

It will disappear 6 tears from the Date of Default - But if there is no date of default well... Time to make a formal complaint to TMS...

Not about affordability but about not being defaulted...

under what rules?

 

theres no compulsion nor any guidelines now from the ICO that say such.

the old guidelines did but they were updated.

Question is whether a default notice was served.. If so it should have been defaulted...

I’ve never had a default notice from the moneyshop. The account say it’s defaulted on their statement they sent me though. Not defaulted anywhere on cars just late payment markers.

 

I don’t know what to do I’m getting conflicting advice here

No you are not

Its a true reflection of how you operated the account

The only thing you might poss do is get a default registered at 3 in 2014

But it will still be there till its 6th birthday

 

You want a magic wand

There isnt one sadly

just pointing out its not a guaranteed magic wand.

 

it should [and note I say should, !!] charge the status of the loan to show settled.

but that wont remove the late payment records in the calendar section

however AFIAK mortgage companies don't have access to those so wont know its had a poor history.

 

but ive also seen that it didn't remove the late payment status, just like if you pay a debt off if its had a default notice issued

it still says default by also shows as settled.

 

the late payment status is something registered by the debt owner, its not as a result of what the last calendar marker said..

so as you cant see it can be hit and and miss IF it stays or goes.

Ok so yeh they said it would only be partially settled if they accept my offer.

 

So just wondering if it’s already showing that I haven’t ran this account well. Is it ok credit file wise if it just says partially settled rather than settled.

oh yes sorry. small screen time.

 

why don't you offer to settle it then but ONLY if they register a default 03/14, that way whatever they put PS settled etc will be gone 2020

 

or demand its only marked as settled
