Civil Enforcement LTD claim form

Hi,

back in November my daughter received a PCN from Civil enforcement ltd. stating she hadn't paid for parking.

The parking was in a conservative club that you had to pay for on your phone. S

 

he arrived at 12:08 and left at 12:27.

In this time she didn't have her phone on her so ran into the shop to see how she could pay as the club was closed.

(the only place to park to visit this shop is the club).

They couldn't help so she returned back to the car and left.

 

She later received the PCN then a letter from ZZPS saying they will instruct their solicitors to chase up the now £140.

Then another letter arrived from QDR wanting £236.

 

Now she has received a claim form from Northampton from civil enforcements saying she will be going to court.

We are not sure where to go from here.

Any help would be appreciated

It can be, and is meant to be , intimidating to get a succession of letters ramping up a charge for what they refer to as unauthorised parking.

The truth is that the maximum they can actually charge is the amount quoted on their notice in the car park.

 

Please complete the questionnaire from Andy above so that we can show you the best way to fight their ridiculous claim.

 

It also seems crazy that there is only one way to pay-especially by phone since batteries have a way of running out at critical times and a lot of older people do not carry mobiles anyway.

There is some good news regarding CEL court actions, they dont turn up for the hearing if the claim is defended, they dont want to go to prison for fraud.

 

Now,

we need tyo see who has signed off the form for CEL as well as seeing exactly what they are claiming and why.

The chances of them actually making a proper and coherent claim is minimal, a

 

s said they do this to intimidate and try and coerce you into paying.

Ashley Cohen likes to try later on to charge £400 for writing a witness statement for something he is not a witness to just to get the amount claimed over the £600 threshold for getting the bailiffs in should you ignore it all and lose by default.

 

We also need to see the signage at the site and the letters sent at the time as they are not that likely to be compliant with the POFA so leaving them in bother for chasing the wrong person for reasons not allowed.

 

She must acknowledge the claim , by either returning the paperwork saying she intends to defend in full or by opening an account online with moneyclaimonline and then ticking the relevant box.

 

This then gives her an extra fortnight to look out the paperwork and to get some pictures for us to use in preparing her defence,

which at this stage will most likely be a simple denial for the claim because of x and y without going into detail that is time consuming and unnecessary at the moment.

 

The chances are once CEL see that she isnt going to burst into tears and fall over at their command they will probably give up as they normally do.
