[if mcol is not working return after the w/end or the next day if week time] .  register as an individual  note the long gateway number given  then log in .  select respond to a claim and select the start AOS box. .  then using the details required from the claimform .  defend all  leave jurisdiction unticked   goto the defence filing section  file the following:     1 The Claimant's claim was issued on (insert date).  2 The Defendant contends that the Claimant's claim so issued is a claim in contract and is statute barred pursuant to the provisions of section 5 of the limitation act 1980.  . If, which is denied, the claimant contends that the Defendant is in breach of the alleged contract, in excess of 6 years have elapsed since the date on which any cause of action for breach accrued for the benefit of the Claimant. .  3 The Claimant's claim to be entitled to payment of £[insert figure from their POC]  or any other sum, or relief of any kind is denied. .. ..ends..   dx          
    • I passed on the article and link to friend. Between us we will now try get the required info to the correct location so that they (whoever in the Govt) can sort out what he is owed.     • numerous erudio/drydens claimform threads here already - use our search top right.   your appears to be statute barred as you've never heard of erudio so would not have deferred since your last direct deferment to SLC in 2013    if you wish to bother to even send CCA/CPR that's upto you but the bottom line is to erudio you've ignored everything to date yoy might also ignore a claimform.   but ofcourse you are not!!   if the above is true   pop up on the MCOL website detailed on the claimform.     • Well I would want my £50 back also but hey ho if your satisfied its been resolved.....there was no way you could ever be liable anyway as your contract was with TC not RC.   Thread title updated.   Andy
    • Have you not already served a CPR 31.14 ?   You dont request the agreement by way of a CPR 31.14 you use a CCA (section 78) request which you have already done and they have not complied.Therefore they remain in default of your request and unable to enforce the agreement.   Screen shots of the application/sign up are not compliant with a Section 78 request.

Hi hoping someone can help/advise,

 

I received a CCJ for the amount of £2802.71 for a credit card. England based.

 

I can't pay this and on the form it does not tell me how I can pay this off in instalments.

 

I have lots of debt which I am dealing with but this one slipped through, my fault totally.

 

Any advice on how I should proceed would be much appreciated.

NEed more info. Who was the company who go the CCJ. Who were their client?

Who was the original creditor?

 

What happened?

 

YOu say England based? Are you in Bonny ol' Scotland?

Hi, thank you for the quick response and the welcome.

 

Personal Credit Card with either Vanquise/Aqua

Claimant: Arrow Global Limited

Payment to Restons Solicitors Ltd

 

Yorkshire based.

 

Did go through CCA they came back with the proof and I got distracted with other debt problems and missed this resulting in CCJ

vanquish nor aqua are linked so they cant put both in the claimform.

 

 

so which is it?

 

 

and whats the date on the CCJ?

Can't place the paperwork, but the original debt was with either Vanquis or Aqua

 

The Judgement for Claimant (in default) is dated 22-MAY-2017

did you not get the claimform or anything before the judgement?

or you did and simply ignore it and not defended?

 

 

you could do a setaside or vary it [probably best N245]

 

 

is it a recently taken out card?

Did not defend, caught up with other stuff and life in general, no excuses.

 

No not resent. I wondered about the N245? Would I use that to setup a payment plan?

yes n245 variation order.

if you don't think you've a setaside reason?

can you not phone northants bulk and get a copy of the CCJ sent via email/PDF to you.

then you'll know?

so what date did you take this card out?

The card was taken out about 5 years ago.

 

I'll do what you suggest and ring and get a copy of the CCJ via email.

OK I rang the court and ended up on an automated line and they said I would need to pay a £50 fee with the N245 submission.

 

I was under the impression though that if it was within 14 days of receipt of CCJ no fee was payable? can you advise.

A redetermination is free if submitted within 14 days..but a redetermination can only be submitted if the judgment has already stated in monthly payments.

 

I assume yours is a forthwith judgment (the whole lot due now) so you have to use the n245 to vary the forthwith to monthly payment.

 

You may qualify for fee exemption if on certain benefits or low income

Thank you Andy. Nipped into the local Court and they were very helpful, so all good now and N245 is the route.

 

Also thanks to all with advise and help much appreciated.
