    • At the and of July I got clocked for doing 59 in a 50 dual carriage way by a mobioe speed camera.  A week later I sent a GDPR request pursuant to article 15 to release photographas which they did not at the time NIP was sent out.    I signed my name that i was driving and refused to take the 3 point and 100 points pending the outcome of gdpr   All was forgetten untill today an SJP turns up at doorstep about 5 months later. What are my options. A. Guilty  b Not guilty citing non compliance of GDPR as mitigating circumstances?    Being security cleared if i get it on my record I would have to delare if found guilty. will the clearance be taken away whats the impact on future employment.    Kind of think i messed up big time? getting a solicitor will help ? any advise appreciated 
    • I'm also on the staff bank and had a substantive post too until recently. This was something our health board did ages ago, it is basically to make you actually take holidays. They should be paying you the average of your last 12 weeks rate, thats what a lot of people got backdated pay for a few years back (sure it was the 'pay as if at work' campaign they called it) but you need to request annual leave and wont be allowed to work the days you have taken leave. This was a huge issue in my health board and I would be surprised if other boards didn't take the lesson mine learned the hard way on board because they ended up having to pay a fortune out to people for leave and sick pay that had been paid at basic rate.  Its the same calculation for sick/carers/parental/maternity leave too, its always based on an average of the last 12 weeks pay
    • When you have completed your SD you will almost certainly be asked how you plead to the offence(s). Hopefully you have been "dual charged" with both Failing to provide driver's details (FtP) and Speeding. So long as you were driving at the time of the allegation you should offer to plead guilty to speeding providing the FtP charge is dropped. Do not under any circumstances plead guilty to speeding unless and until you have this agreement. You cannot be convicted of speeding unless you plead guilty as they have no evidence that you were driving. The danger in pleading guilty without the deal is that you will be convicted of speeding and they can still continue with the FtP charge. On the basis of what you have said success will not be impossible but will be problematic and the possible outcome is nine points. The "deal" is a well known procedure to prosecutors and Magistrates and is exercised in courts across England & Wales every day and is nearly always accepted. It is nearly always accepted. If you can, arrive at court early and ask to see the prosecutor. You can put your offer then. If not, make the offer when you have completed your SD. If by any chance it is not accepted, plead Not Guilty to both charges and come back on here (your case will be adjourned to a later date). We can then decide whether you have a reasonable chance of successfully defending the FtP charge. Certainly at this stage you do not need a lawyer. You probably wouldn't need one if you have to defend the FtP charge either but let's wait and see what happens on Friday. Save your money for your fines, etc.   You need to make every effort to avoid a FtP conviction. It carries six points but most importantly an endorsement code (MS90) which insurers hate and it will see your premiums increase dramatically.

I don’t know what I’d actually do until I’m in the situation.   What then if (early on in the Wuhan outbreak, before the travel embargo) I am already booked on a pre-planned flight out? Public opinion (looking at the case of the ‘Michelin traveller’) says to travel would be selfish.   What if I had a temperature, but my flight (booked before the outbreak) was to visit a terminally ill relative, who had only a very short time remaining?. Things are rarely cut and dried.   What would you (anyone, not just me and HB) do? Do you believe that what you think you’d do (when considering the issues) is going to always be the same as what you do when actually in that situation?   Human factors. Hi hoping someone can help/advise,

 

I received a CCJ for the amount of £2802.71 for a credit card. England based.

 

I can't pay this and on the form it does not tell me how I can pay this off in instalments.

 

I have lots of debt which I am dealing with but this one slipped through, my fault totally.

 

Any advice on how I should proceed would be much appreciated.

NEed more info. Who was the company who go the CCJ. Who were their client?

Who was the original creditor?

 

What happened?

Personal Credit Card with either Vanquise/Aqua

Claimant: Arrow Global Limited

Payment to Restons Solicitors Ltd

 

Yorkshire based.

 

Did go through CCA they came back with the proof and I got distracted with other debt problems and missed this resulting in CCJ

Can't place the paperwork, but the original debt was with either Vanquis or Aqua

 

The Judgement for Claimant (in default) is dated 22-MAY-2017

did you not get the claimform or anything before the judgement?

or you did and simply ignore it and not defended?

 

 

you could do a setaside or vary it [probably best N245]

 

 

is it a recently taken out card?

Did not defend, caught up with other stuff and life in general, no excuses.

 

No not resent. I wondered about the N245? Would I use that to setup a payment plan?

if you don't think you've a setaside reason?

can you not phone northants bulk and get a copy of the CCJ sent via email/PDF to you.

then you'll know?

The card was taken out about 5 years ago.

 

I'll do what you suggest and ring and get a copy of the CCJ via email.

OK I rang the court and ended up on an automated line and they said I would need to pay a £50 fee with the N245 submission.

 

I was under the impression though that if it was within 14 days of receipt of CCJ no fee was payable? can you advise.

A redetermination is free if submitted within 14 days..but a redetermination can only be submitted if the judgment has already stated in monthly payments.

 

I assume yours is a forthwith judgment (the whole lot due now) so you have to use the n245 to vary the forthwith to monthly payment.

 

You may qualify for fee exemption if on certain benefits or low income

Thank you Andy. Nipped into the local Court and they were very helpful, so all good now and N245 is the route.
