And to strengthen your case take a look  look at a thread by Tom Price also at Southend airport which is several threads below yours and you will see that he won his case on the fact that he was stopped rather than parked. On top of that he had the Airports Act  1986 to quote. The relevant section is no 63 " Byelaws are covered at S.63  (2)Any such byelaws may, in particular, include byelaws— (d)for regulating vehicular traffic anywhere within the airport, except on roads within the airport to which the road traffic enactments apply, and in particular (with that exception) for imposing speed limits on vehicles within the airport and for restricting or regulating the parking of vehicles or their use for any purpose or in any manner specified in the byelaws;" That confirms that the roads at the airport are either covered by the Road Traffic Act or Byelaws neither of which is relevant land therefore  PoFA cannot apply. And  VCS should be aware of that. Another thing is that when you posted their WS you didn't include their contract which I missed at the time. However Tom Price included it in his. And guess what-the  alleged offence they are pursuing you for, No Stopping, is not included in their contract. If you look at the end of their Service Agreement [aka contract] you will a list of contravention on Scedule 1 [7] (46) PARKING/WAITING ON A ROADWAY WHERE STOPPING IS PROHIBITTED That is the nearest to what you did. But you were not parking nor waiting -you were stopped so there was no reason to issue you with a PCN as you never broke any of their contraventions. Looks like they breached your GDPR and you should include that as it carries a hefty charge £750 is not unheard of.   Have a read of his WS too which may give you further ideas even possibly to rebut some of the points VCS  make.

    • As you have made this so black and white, I have just realised I have probably made a total mess up here 😕   Yes, the original RBS mortgage from 1999 changed in 2009 to a buy-to-let with a different mortgage company, for the same property.   As I thought I had to have a life assurance, this would be ok, even though it was a much smaller amount.   It states the policy holder as myself and the property address and says 'in return for the payment of agreed premiums the company will pay the benefits in accordance to the policy conditions' it doenst really specify who would be paid. I have actual document here.   Something to mention, when I bought this property it was uninhabitable and I have never actually lived there. It was empty for ten years until 2009 when I got some additional borrowing, renovated it and let it out.   In 2011 therefore when it changed to Aviva, that mortgage had been paid off 2 years before.   I have a feeling you are going to say it was my responsibility to have cancelled the policy in 2009 with RSA or with Aviva?     As I had been advised by RBS, I thought I had to life insurance/assurance of some kind as I had a mortgage.

      Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
      So I issued the claim on day 15 and they requested more time to respond.
      They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
       
      I opted for mediation, and it played out very similarly to other people's experiences.
       
      In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them. 
       
      In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
       
      In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
       
      To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
       
      So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.

Others have noticed the same thing no idea why, one can only hope as you rightly say employers do not see any value in the site but would still expect to see parasites posting fake jobs at the least.

I have just discovered on find a job how to find the latest jobs click on the box it says most relevant and change it to most recent and then you will see all the new jobs that has been put on find a job since your last visit to find a job.

This is my first post here, and the forum rules say that I can’t post links until I have made 10 posts.

 

The new Find a Job site is not mandatory to use. A response to a Freedom of Information request asking if jobcentre staff can mandate you to use it says:

 

“Claimants cannot be mandated to use the Find a Job website specifically. However, under Day One Conditionality in JSA, claimants are asked to create an account and upload a Curriculum Vitae (CV) in Find a job or another jobsite when they make a new claim. This requires claimants to have a suitable email address and to upload a CV to their Find a Job or another jobsite account. Where a claimant has not done this, their Work Coach can mandate them to do so.”

So what this means is that job seekers cannot be pressured under threat of sanctioning (or forced to put in their Claimant Commitment) to use FaJ for their job searches and job applications.

 

You could be mandated to create a FaJ account and upload a CV to it but you can’t be mandated to use it.

 

So do a printout of the attached PDF version and show it to your work coach if they try to pressure you into using FaJ.

I have noticed while job searching on my find a job account that the jobs advertised on this site only seems to be for certain types of work like management, hospital and other highly skilled jobs which are no good to me or lots of other jobseekers using this site to look for work.

I have discovered that you can search for jobs by miles from on the advanced search section of find a job service

 

you just need to fill in the appropriate boxes with the info you need for your search for jobs and it will just all job search sites go by as the crow flies meaning you will get jobs that you would like to apply for and find they are too far from home for you to get to in the 90 minutes limit you have on your jobseekers agreement

 

it does seem that you will have to an account on find a job service and allow your job coach see you find a job account even though it is believed this is not compulsory at the moment.

I just saw this job:

Sales Assistant (ME4 4EP, Darker Enterprises) advertised on find a job and then went to Google maps to find out where it is

 

it is in Chatham area of Kent and according to Google maps the shop is now closed.

 

so it asks that question is this job Sales Assistant (ME4 4EP, Darker Enterprises) a fake job.

If this is the same Darker Enterprises that I'm finding hits for with a web search, just be aware of what it is exactly that they sell. From their web site:

i am pleased universal jobmatch has now closed and replaced with find a job

 

the dwp staff as come up with a crafty way to know what you are doing jobsearch wise and the crafty way is to get to do a reclaim for benefits and get you to create a universal jobmatch account where you have to put down what jobs you have applied for and also upload your cv.

 

you are not able to do this on find a job and dwp staff do not have access to it.

 

I knew from the first announcement of find a job replacing universal on 25/4/2018 that the dwp staff would find a crafty way to find out what you are doing to look for work.

Considering you have to show what you are doing to look for work at a work search review, what was the issue as surely it would save you having to write stuff down?

No need to write anything down at all just have a regular conversation with your WC, no need to go into detail.

 

If they doubt your uncorroborated evidence ask why ?

 

Just make sure all the steps you have took that can be evidenced such as an online applications your are able to produce if a doubt is raised against your claim.

So again if you are doing it anyway, why be an a**e about it and face a potential doubt? Just seems a pointless exercise to me, but it's you're benefit they might stop, so do what suits.

Simple, the more you give them, the more they try to pull you up on.

It is not being an ass to have a conversation about the efforts taken when finding work, there is no compulsion to write anything down, recording it is for your own benefit, and unless you have said something which is contradictory or highly improbable then they they cannot raise any doubt.

 

Example last week when signed I only had 1 job application so that would be really silly to write down and hand over do you not think ?

 

when I can just state this during a regular conversation between 2 human beings ?

 

So the only ass here would be the work coach to raise a doubt BTW I took 3 steps each week just found 1 vacancy.

just been doing my latest jobsearch on find a job and saw a job that I wanted to apply for and clicked on the apply for job button it took me thought to the employers website and it said job expired and this happened with the same job on 21 September 2018 and happened again today 3 October 2018 the job is: Sales Assistant (Chatham, South East/Southern, ME4 4NZ, Go Outdoors).

Some of the larger employers have set their systems up to send a notification of new vacancies when they are posted. Would be worth checking with Go Outdoors to see if they do something similar. Failing that, bookmark the page and then visit the web site each week, logging it as one more action to seek employment.
