    • I drove a friends a car for a few days and I used cuvva car insurance to insure myself for the time period. Here's the problem: I made a mistake with the dates on the insurance, I ended up driving uninsured for one day and I got a speeding ticket. My friend named me as the driver on the Notice of Intended Prosecution as she should and I will take the blame of course. Will met police ask for proof that I was in fact driving? I mean, any more other than me replying to the NIP that I will soon receive from them? Cause I assume that my insurance for the day will be the proof that they need... Secondly,  if caught driving uninsured, what will happen please? I read it's £300 and 6 points. Is that all or is it worse? I'm only asking for information from knowledgable people. If you intent to just mock, you're certainly not helping. Thanks

    • This is the first item that I've ever claimed for - I don't really send too many parcels, probably 5 in the last 5 years, and only two with P2G / EVRi. I've attached two emails from P2G regarding their requiring the documents. They don't specify in the emails what documents I should be sending, although when opening the claim they were requesting that I needed photographic proof of sending - picture of the parcel with their label attached, in the EVRi ParcelShop. The second email is their closing the enquiry due to my failure to produce said document(s). I haven't yet drafted my claim letter, I wanted to be sure of this document situation first before I began action. But therein lies another problem. Not having a P2G account, I cannot be sure of the item value that I declared. The retail value at the time was £600, which is less than the £650 I paid several months earlier, so I would likely have used that, but cannot be sure. And without having an account I can't check either. But, I know that I did properly declare the item and a value that reflected its then retail price - I was concerned this declaration may have been used to single the item for theft. But now that the retail price has reduced substantially, even though the nature of compensation is to return the claimant back to their original position, without my purchase receipt, I was concerned that I may have to claim for less. And yes, I've been through your huge document store of information, in addition to MoneySavingExpert, Which, Citizens Advice, Gov.uk "make a court claim", my own law books (annoyingly I specialised in consumer law when I studied for my law degree, but I graduated 17 years ago), and so now feel that its time to either act, or drop it.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

We started renting a beautiful home in December. We pay £1,800 a month for the house which is a hell of a lot of money.

 

We have had a letter saying building works begin on a patch of land next to our garden next week and the foundations mean they will have to take down our fence and work in our garden!

 

We both work from home which will be impossible with the noise. We also have a dog who will go berserk at the builders in the garden and she wont be able to go outside.

 

We are absolutely gutted that our dream home has become such a nightmare and we will not be able to use the garden for over 2 months! Well, we can, but not privately!

 

Any advice on if we can refuse to pay rent? or at least get a reduction? The landlord knew about this and did not tell us before we moved in. My other concern is that our garden will now be completely overlooked by the new house.

 

Any advice please?

You do not say who the letter about the works was from? (landlord, contractor etc)

 

I would not under any circumstances refuse to pay rent as all you would be doing is giving the landlord ammunition to use against you if they wished to take it further if you do.

Your the lease holder, if they come kick them off, its your right.

The landlord can do diddly squat about it. Just in the same way the landlord cannot just walk into the property when they feel like it.

Its your home, you signed the lease.

So kick them off, if they refuse call the police, show them the lease and tell them you want them off. If the police say its a civil issue, just say you'll be removing scaffolding etc at night and putting it back on their property.

the builders can go to court to enforce the access so i would suggest that you refuse them access UNLESS they compensate you for your loss of amenity. so how long will the work take if they are paying you £1800 a month for the access? i bet they can do it quicker. If they trespass you can sue them and even get an injunction to prevent them reoffending. this is expensive but they will foot the bill so let them know in your letter demanding compensation that this will happen if they cant reach an agreement.

Now, being realisitc I would have thought that £600 a month is reasonable for the loss of use of the garden but start off with the higher figure aand see waht they come back with. it is only the cost of an extra labourer for a week for them

so get your letter drawn uop and given to the company or better still the landowner pronto
