Might not be stayed...defence submitted 18th April...claimant has 33 days to respond and signify if they wish to proceed...subject to date of the letter in post #23 they may be in time ?

I acknowledge the receipt of your defence. A copy is being served on the claimant (Or the claimant's solicitor) The claimant may contact you direct to attempt to resolve any dispute. If the dispute cannot be resolved informally, The claimant will inform the court the he wishes to proceed the spirt will then inform you of what will happen.

 

Where he wishes to proceed, The claimant must contact the court within 28 days after receiving a copy of your defence. After that period has elapsed, the claim will be stayed. The only action the claimant can then take will be to apply to a judge for an order lifting the stay.

Looking at the bills I don't think there has ever been a payment made as I didn't know the account exsisted. Looking at the dates it could have been my ex partner who opened the account in my name without me knowing.

I know it's fraud my ex partner had done this quite a lot and I have paid off everything else because they all appeared on my credit report but this one didn't show on my report so never knew about it.

 

I know it's fraud but that doesn't help me with what I need to do to sort this out.

I would say report it to the police

 

the tell the claimant it is fraud and give them the crime ref number

if a payment was never made at what point would the 6 years of the statute Bar kick in would it be from when the account was created.

I have just got off the phone to talk talk after a hour of being on the phone to them. They are refusing to provide me information i am asking for because i don't know the email address the account was set up with. They have passed this onto their fraud team who will call me within 5 working days.

I have provided them with Talk Talk Account number , Address it was registered at and even billing information and they are still saying they cannot verify who i am.
