Hi All,

 

I've recently been contacted by a DCA for a debt which was left behind (not proud) in 2006. The last contact I had was in 2008.

 

Taking into account the powers that DCAs do/don't have, and all the guidance on this forum, are there any legal practices in the UK who might offer some advice on liability?

Don't respond to a DCA. If a foreign creditor wishes to enforce a debt in the UK, they will instruct UK Solicitors.

 

Don't contact any organisation that advertises on Facebook and Twitter etc services helping with middle eastern debts, which are mainly about negotiating a repayment plan, which seems to include a commission for their services.

 

To answer the question raised about liability, this is currently registered in the country where you took out the debt and any other countries which recognise the debt.

 

You might be aware that debt in middle eastern and some other countries is not purely a civil matter. It is therefore not advisable to travel to or via middle eastern countries or any other country where the debt has been registered. Before travelling, you should seek advice from an official source. E.g Foreign & Commonwealth office.

 

A foreign debt can be enforced in a UK court, but the foreign creditor would have to instruct a UK Solicitor to issue a UK court claim.

 

Before issuing the claim, the UK Solicitors would have to send you a letter before claim, giving you a chance to request information, seek advice and if necessary look to negotiate repayment.

 

The limitation period in many foreign countries is much longer than UK and this longer period can be applied in the UK.

Yes please don't fall for these sites and groups that appear to want to help

And don't fall for the stories you read there either

 

Most are patsy stories to frighten you into paying by saying look what happened to this debtor.

Thanks, all, for the replies and advice.

It's along the lines of what I already suspected, but it's good to have it clarified.

 

I'd assumed that if there had been a demand for these kinds of legal services, there would be more of a market for them

- clearly the demand is not there meaning the cases are few and very far between.

 

I have avoided any gulf/GCC territory and will continue to do so. If there are any developments, I'll come back to post them!
