Hi there

This is an update of my original dmp CCA Request thread.

 

Barclaycard CC taken out 2008, Link took over 02/2015

Amount £1800 was paying £20 on dmp

I stopped paying LInk 08/2017, did the 3 letter process, sent for a CCA request 21/01/2018. The 12+2 time has passed no reply until today.

 

I have received a statement of account letter, they have acknowledged the CCA request and credited my balance with the £1 fee for the CCA.

 

Can they do this ? Should I wait for further responses ?

 

Any advice is appreciated, thanks

No such thing.

 

They can do whatever they like with the £1 stat cca fee, it won't reset the limitation clock.

 

Wait for the CCA, however, this was post 2007so was it an online agreement?

 

Who was the DMP, and are you still with them? What was the reason you stopped paing sharklaycard in the first place, and why did you stop paying Link?

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

I can’t remember if it was online or not.

Dmp was with debtmovers/Moneyplus, I ditched them when I realised they were charging me £37.50 for their services. They managed my accounts, I got into too much debt and could not keep up the payments.

 

Barclaycard agreed to a lower payment of £20 a month from 2009/10

They then advised me link had taken over the account 2015, payments continued through dmp to 08/2017. I offered a full +final payment to link but to no luck. This is when I stopped paying them.

 

I stopped paying because I was struggling to keep up with payments, I offered to pay £10 a month, but they were not prepared to accept. They wanted a full expenses and expenditure form filled out, I refused to do this.

 

The account was opened on 08/2007 sorry for the mix up of dates

Have you got copies of payments made to Moneyplus?

 

Have you also got copies of the money they sent to sharklaycard?

 

Have you got an annual statement of account from Sharklays?

 

What is the total outstanding now?

 

If sharklays have refused your generous offer of £10 a month IN WRITING, then drop the payments down to £1 a month for the life of the debt.

 

IF, you've been corresponding with the clowns over the phone or email, then STOP, and get a paper trail of evidence together, along with your offer, which is VERY generous!

 

Have you reclaimed everything you can off the account? PPI, fees, charges, interest?

Have you got copies of payments made to Moneyplus?

Direct debit through bank account

 

Have you also got copies of the money they sent to sharklaycard?

Just the statements from DMP company, and now the statements from Link Financial

 

Have you got an annual statement of account from Sharklays?

No, just the statements that Link Financial send me

£1800 now, £3000 originally

yes i have been on the phone to Link financial (not any more), last contact 09/2017

 

Have you reclaimed everything you can off the account? PPIicon, fees, charges, interest?

Barclays agreed to freeze interest and did so, i don't remember having ppi, i honestly don't know if there were any charges applied to the account

Hello there

 

A quick update, link have now defaulted the account, even though they have not complied with my CCA request.

Can they do this ?

 

I was under the impression that until they comply with the CCA request the account is in dispute ?

 

I really don’t need a default as I am trying to get a mortgage.

 

Any advice is appreciated

either ring BC and ask what date they defaulted the card [i bet they did}

 

LInks default is meaningless and they cant default you only the OC can.

 

get an sar running to Barclaycard

find out if they defaulted you before.

is this showing on your credit file still?

Hello there.

I have got my documents from Barclays.

This account was defaulted 02/2015 by Barclays.

 

DX is right it was defaulted and then LINK took over 08/2015 as this is the date shown on credit file for Barclaycard account closed. Balance zero.

 

Any advice on what to do next is appreciated

Make a note at side of the entry ...CCA request fee..not payment towards the debt.

 

Just gone through some letters from link I did receive a letter titled

“”Default notice served under section 87(1) of the CCA 1974””

This was in 01/2018 because I was in arrears with LINk since I stopped paying them .

No reply to CCA Request

 

Link cant issue a Default Notice...they are a DCA not the creditor.

What would be the best thing to do ?

Do I write a letter to link informing them they can’t issue a default ?

 

It’s strange how they are always sending letters for this account only and not my (Morgan Stanley) account, which has not been defaulted by link yet
