Bailiffs in at greater Anglia Railways after passenger sues for delays

 

Greater Anglia sued by passenger over 'continuous' delays

 

 

 

 

A commuter fed up with "continually" delayed trains has won a legal bid for compensation against the rail company.

 

Seph Pochin, of Halesworth, Suffolk, had described the service between his home and Ipswich as "woeful", with one train delayed by 100 minutes.

 

A warrant has now been issued for bailiffs to seize Greater Anglia (GA) property after it failed to pay him £350 compensation.

 

GA confirmed it was in a legal dispute with Mr Pochin but could not comment.

 

Mr Pochin, an ecologist, who moved to Halesworth a year ago, said he was considering moving to Ipswich to avoid the delays, which he claims added up to almost 28 hours over 12 months.

Of course these are County Court bailiffs with fairly limited powers – but when dealing with a large customer-facing company such as a rail service provider, enforcement will be fairly straightforward but the most important thing is the publicity that it creates.

 

This guy is action against this large company should be an example to anybody who is dealing with a rail company, with a bank, with large national retail outlets et cetera.

 

Don't hang around. Don't get jerked about. Issue the court papers and then watch them roll over. I fully imagine that the reason that there was a judgement issued against Greater Anglia was because they didn't deal with it and it was probably a default judgement. Now they regret it. The cost of it all of course is peanuts. But the damage to their reputation and the encouragement to other passengers to take the same action is powerful stuff.

 

This also puts paid to the myth that you have to accept their vouchers as a derisory compensation for their continuous delays and cancellations.

 

As this guy has found, starting a small claim is extremely easy – very cheap – and can have very powerful consequences.
