Hi all

Was wondering if any of you have had any dealings with Frederickson and Capital One?

 

My dh offered an 80% full and final settlement figure to Frederickson for Cap 1 debt and it was accepted.

 

Before he could pay he received a letter from Capital One saying that the debt had now been returned to them??

 

Any ideas as to what he should do?

did he send a CCA request first?

look court would be long way down the line, even then if things went wrong a Tomlin Order could be an out for the case, lowells unless you are going to pay them need not have the income etc non of their business.

 

do not want to go to court?? we all say that in the beginning, not what you see on TV just a side room with desk and chairs and a person (Judge) sat ahead of you and that is all you and representative of you and claimant do not jump the fence and pay unless they prove conclusively that they are entitled to monies then wait as see the facts first?

 

have seen cases when lowells went to court to claim £14000 and they lost, it cost them a hell of a lot = that is why these days they tend to Discontinue court cases just before the case is due to be heard, if they can see they will get smashed in court read threads on lowells

No, I haven't spoken to them but my husband has so I have taken over as I know a little bit (not much but more than hubby).

He is so frightened of being taken to court tbh and he has read somewhere that Lowells do take you to court. I will send CCA Request.

Hi everyone.

Well I sent the CCA request and received letter from Cap1 with a copy of the credit agreement that was signed online (digital signature).

They also enclosed a copy of his defaulted agreement and default notice dated Oct 2016.

 

They are saying they will not be entering into any further correspondence and that the agreement is enforceable and they will continue to treat it as such.

Also that payments must be made on the account.

 

However, when dh tried to log onto his account online it wouldn't let him, stating that he must ring them.

Anyone know what's next? SAR?

It was sent back to Capital 1!! DCA's no longer dealing with it.

I received the CCA and T&C's but have no idea whether they are correct :| Should we SAR Cap 1 do you think?

unless you know there are lots of "12 penalty fees for being late/over limit

and if a card of that age I doubt it?
