    • no don't call them. you say they DONT mention at all the other times of usage? usually it will say byelaw bla bla  and in the statement say and XXX other times counted to [no.] being TIC if you plead guity and attend which you MUST do
    • Thank you for clearing that up BazzaS.   I am under the assumption that the other offences are TIC given the fact that I admitted the period of use (5 months) in my first letter which gave my explanation of events. In response to my first letter, they decided to prosecute me for the single offence (under the byelaws).    I will call them to double check on this though.
    • Thank you for your help. I do understand and I can see how it looks to tax credits however they aren’t telling me exactly what evidence they have. When I called them last week (haven’t spoke to the compliance team since) he said there is strong evidence but didn’t say what and then asked me what doctors he uses? I said I have no idea as I don’t.   do you think I should contact them again and explain everything again and also about the universal credit claim and what they advised? Just feel I’m gonna be in the wrong no matter what I do now as it’s either do a joint claim but he ain’t here in that capacity or do a single claim but risk it being investigated again due to him using this address.
    • How much (practical, not just academic) criminal law did your two law degrees cover?   In this context, TIC : “taken into consideration”.   If they ask about the others and you admit them and ask for them to be taken into consideration, then they can’t come after you for them later, they will be disposed of at the time the specimen charge is heard.   If they don’t ask about them and you offer them, they might offer to have them TIC, or it might persuade them not to offer an administrative settlement. There is a theoretical downside to not coughing to them, though.   If TfL prosecute you for one offence and don’t ask about any TIC, then you only get prosecuted for that one. There is then the theoretical risk they could come after you (within 6 months of the offence) for any other offences committed, if they discover them. If they are TIC you are protected from this.
    • They are charging me for one use essentially i.e. being in a compulsory ticket area without a ticket. What do you mean by TIC?

    • This is a bit of a lengthy one but I’ll summerise best as possible.

THIS IS HOW THE PHONECALL WENT

I was contacted by future comms by phone, they stated that they could beat any phone contract I have , (I am a limited company but just myself that needs a business phone and I am the only worker)
I told future comms my deal, £110 per month with a phone and a virtual landline, they confirmed that they could beat that, £90 per month with a phone , virtual landline  they also confirmed they would pay Vodafone (previous provider) the termination fee. As I am in business, naturally I was open to making a deal. So we proceeded.
Future comms then revealed that the contract would be with PLAN.COM and the airtime would be provided by 02, I instantly told them that this would break the deal as I have poor 02 signal in the house where I live as my partner is on 02 and constantly complaining about bad signal
the salesman assured me he would send a signal booster box out with the phone so I would have perfect signal.
      so far so good.....
i then explained this is the only mobile phone I use for business and pleasure, so therefore I didn’t want any disconnection time in the slightest between the switchover from Vodafone to 02
the salesman then confirmed that the existing phone would only be disconnected once the new phone was switched on.
      so far so good....

in October 17 I asked Barclays for help stopping interest in my credit card and accept my minimum payment of 50each month explaing my difficult situation (due to gambling pay day loans, unsecured loans different thread ) , I was honest and I provided budget spreadsheet

they refused saying that I won’t able to pay the 50 and they will continue to charging me the minimum repayments what was over 80 each month and I was paying. They immediately cancelled my card which on that time was ok for me because I didn’t have plans to used any more only start to repay.

I received todays letter that they registered default on my account and they are asking to repay all outstanding balance 3,500

well I can’t and if not they willl pass my debt to collection agency .

I am shocked because my understanding was that if I am repaying minimum each month on time login to my account it’s ok .

Please help,

I was doing everything to avoid defaults doing for what they asked.

in the beginning I had outstanding over 200 in December

I had letter if I won’t pay this before 3rd of December they will register default

I paid on time and after I was always on time .

Can I still do something to cancel default ???

Can they do this if I was paying my minimum on time ???

The fact that they have declined to assist you when you have asked, tells you everything about sharklaycard.

Have a read of CCOBS and see where they have failed to assist you as a customer, start their complaints process.

If you haven't got all of your statements then send them a SAR (£10) and get reclaiming ALL of their fees and charges including interest at their rate.

They're going to wish they'd given you some help.

Hi Wiosna,

No surprises that BC failed to assist when you asked and tried to do the right thing.

If you've had default charges over the years, these should be reclaimed in full to reduce the balance.

Even if they failed to assist when they could or should have, you're most unlikely to get a default removed by BC unless penalty charges and interest exceed the a/c balance.

:-)

I will have Today call from Barclays, because on Saturday they didn’t want to tell me default amount, she said she can’t tell me!!!!

I am guessing they didn’t update my account after my payment and the same they didn’t stop default process.

yes I did, and before date from the letter and after 3 months everything on time and full payments

I didn’t get call from Barclays regarding my default yet.

Maybe my first post was not enough clear so I will easily explain again (I am sorry)

I sent them letter that I am in difficult financial situation providing budget and offering £50.00/ Month (many loans, payday loans, gambling) and asking to stop adding charges and interest. I did this twice, first by post and after again they requested by email.

After my letter they cancel my card even if I didn’t ask and they rejected my offer telling me that I won’t be able to pay even the £50.00 and they can’t accept it. I called them explaining that I have help from family and I will pay the £50.00, still NO

I had letter requesting in this case minimum payments each Month including interest, what was always over £80.00

I had over £200.00 in arrears because I was waiting for decision.

Received letter if I won’t pay amount in arrears , I think it was before 3rd of November they will register default

Full payment of outstanding amount made on the 1st of November and after each Month everything on time and in full, was always over £80.00

I don’t know why Default has been registered, I called them but I could not get answer.

They cancel now my account so no access and no option to make any payments.

If I remember they send me letter after in December that they can’t help me and they going to register Default but I need to be honest I ignored that letter because everything was up to date with my payments and on time. They include a cheque of £50.00 as an apologies

Card / account was not old, I opened In March 2017 and I stared having problems from end of August 17

Please let me know step by step what to do now, what to send and where to remove Defaults from my Credit files

Hi Wiosna,

The problem is that you did what you thought was right, but you you should have asked for advice here first. By telling BC you were in difficulty, they had no option but to cancel the card to stop you spending any more. If you wanted to avoid the default, you should have continued to pay the minimum each month, but I realise you weren't able to do this. Hence, the default.

They have the right to demand repayment in full. You couldn't repay the amount owed, so the default is lodged. You're not going to get the default removed.

Even though BC had a duty to assist you by considering stopping interest and/or default charges, they would still have to cancel the card and try to get the debt repaid.

I don't see any way you will get the default removed. But, from what you say, your CRA files may not be good anyway.

Best thing in my opinion is try to arrange a repayment amount you can afford based on your budget planner.

Maybe others will have a different view but this is what I think.

The first place to complain is directly to Sharklaycard.

Hi Wiosna and thanks for the info about your CRA records.

I read through your posts carefully before giving my opinions above.

When you asked BC to stop adding interest, this put them on warning that you may be experiencing financial difficulties - this may have been your first mistake.

While you were waiting for a decision about your offer, arrears built up and this was your second mistake.

They decided to cancel the credit card agreement and seek full repayment, which they were allowed to do in the circumstances.

If you want to complain to BC about the arrears that accrued while you waited for them to consider and to re-consider your offer, you can do so. But in my opinion, you're unlikely to get them to change their decision to call in the debt in full; and the are highly unlikely to remove the default marker.

Try if you want as it'll cost you nothing and will do you no harm.

:-)

I spoke Today with Barclays complain department

I heard the most stupid things in my life

- they told me that they defaulted me because I didn’t respond to them after receiving letter telling me that they can’t accept my offer and I won’t be able to make any payments so ....

no checking my account they put default,

I was thinking that defaults are for not making payments not for not responding to letters

She has to ask some Senior to remove it and let me know tomorrow.

I didn’t call them after rejection because I paid outstanding amount before and someone on the phone told me that they going to stop default process and I don’t need to worry about.

I was paying after each Month without any problems
