Some years ago now I got into debt and at the moment I am in a much better position.

 

I have a CCJ that I have not paid anything off and its over 6 years old now and not showing on my credit history.

I have 1 debt that is also statute barred now for around £3600.

 

My wife also has a CCJ that will disappear in August which she has not paid anything off.

 

She also has 1 debt that has a charging order on her half of our house which is being paid.

 

Since all these debts and the charging order there has been a family death and we have paid off our mortgage.

 

Regarding the charging order

would it be worth asking for a settlement?

Bearing in mind that the DCA will know that we no longer have a Mortgage and as far as they know we will never sell our house as we are happy where we are.

 

However we will in the near future want to move to my mothers house as she is now in care, but the DCA dont know that ;-)

So do we try to use this to our advantage to get a reduced full and final?

why are you paying a restriction k?

pers i'd stop paying

and then when the home is sold

your solicitor tells the DCA

 

its a RESTRICTION K they cant enforce anything.

Thanks dx, I didn't know that.

So cancel the payments, we shouldn't have a problem selling the house, the charge will then be cancelled and the solicitors will inform the DCA.

 

What can I expect the DCA to do after all this, this is a CCJ awarded end of Feb 2013. if we stop payments can they go backto the court to enforce the debt?

With HSBC and my wife.

I have been thinking of challenging the CCJ as its been a few years and things may have changed.

Its an old agreement with no T&C on the document and it says "Application form" on the top.

She was also refunded PPI as it was mis-sold so would that make the agreement unenforceable?

I was thinking of putting together a letter stating I have taken advice on the previous court outcome and it looks like I have a good case for an appeal, however I would be willing to look at paying a much reduced amount to settle it out of court as it would be more beneficial for both parties. Or something to the same effect
