i have requested my credit agreement through a debt collection agency acting on behalf of capital one.

 

they have issued me with the document below and a copy of terms and conditions.

 

can anybody tell me if this is an application form or a signed credit agreement enforceable in a court of law.

 

if it is the application form, what letter would be best to send.

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

The debt collection agency is Lowell Portfolio.

 

My husband and i had a joint card with £2000 limit.

In 2008 my husband lost his job and we couldnt afford the repayments.

 

Obviously there was no insurance and we were acruing mortgage arrears at a fantastic rate.

We basically got behind with everything. Mortgage, secured loan and council tax were my main priority.

 

I went onto moneysupermarket site and posted my details.

Somebody suggested sending off a request for my credit agreement.

I thought this would buy me a bit of time and sent off for copies of statements as well.

 

Every request to put account on hold with cap one was ignored and for ages we were charged £24 a month in charges.

 

Total currently outstanding is £950.

I would say at least half is charges.

They wont refund them and i just kept requesting the credit agreement.

 

The above is what they sent me on the last request.

Every time before that Lowell have refered it back to Capital one.

Once i know if this is a legally binding credit agreement i can take it from there.

If it is, i can make a settlement offer.

If it isnt, I will cross that bridge then.

I dont mind paying what i have spent, just the ridiculous charges applied.

 

To be honest - another card (£120) outstanding, wrote it off as they couldnt produce the agreement.

 

They have rejected a settlement offer I made in 2009.

I offered what was spent - minus what was paid - and half of all interest applied.

 

If they agreed, I was going to set up a standing order for a weekly payment of £5.

That was what started all this off.

 

They knew we had next to no income and was strugling, but they insisted full amount was paid.

Its at a stalemate now and i want it sorting but there is no "give" on there part what so ever.

 

Sorry to waffle on a bit, but I've tried to put everything in.

they'll nevef go near court if its mostly charges

 

now

every charge will have int on it.

 

i would suggest you fill in the SOC i've attached

put their lastest int figure in D15

then fill the rest in

 

see what it comes out at.
