Hello,

 

My mother has just called me saying she has received a letter from Athena ANPR Ltd for overstaying 21 minutes at a Lidl store in Melton Mowbray. She did her shopping there, however, she paid cash and didn't keep any receipts from her shop.

 

What would be the best course of action?

Appeal to the parking company?

Contact Lidl?

 

Details below:

 

1 Date of the infringement 17/01/18

2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 19/01/18

 

3 Date received 22/01/18

4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [y/n?] No

 

5 Is there any photographic evidence of the event? On the ANPR camera.

6 Have you appealed? {y/n?] post up your appeal] No

 

7 Who is the parking company? Athena ANPR

 

8. Where exactly [carpark name and town] Lidl Store in Melton Mowbray.

does it say which appeals body they operate under. Yes - IAS

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

Lidl have been pretty good about this in the past,

she can show what time she was there by the ANPR data

and as long as she can remember a few of the items on her shopping list

they will be able to find the transaction on their system.

 

Using this information she can tell the CEO that she was a genuine customer etc and ask them to cancel.

 

She should also ask the CEO about whether the planning permission granted for the building of the store has any mention of parking restrictions and ask for the planning application reference.

 

That will give Lidl an idea of where you may be going with this and they may well decide to instruct Athena to cancal without actually bothering to look up what you ask about.

Well that was easy.

 

Before I could tell her about the advice posted above,

 

My mother contacted Lidl,

they told her to email the parking company with a screen shot of her statement to show she had been there.

 

She did that and the parking company cancelled the ticket straight away.
