On receipt of this claim   We requested information pertaining to this claim from the Claimants Solicitors by way of a CPR 31:14 request sent via 1st class recorded post on 7th November 2019.   To date we have not received the requested information.   Therefore with the court’s permission the Claimant is put to strict proof to   a) show and disclose how the Defendant owes the amount in the claim; reference S-1002591 from the FSCS confirming the rejection. Letter from the claimant dated 8th October 2019 confirming the above   b) show and disclose how the Claimant has reached the amount claimed for;   c) provide a copy of the agreement and Terms and Conditions;   d) provide copies of telephone conversation with Michael Cooper 10th July 2019 and 1st November 2019   e) copy of the signed acceptance form for any redress from Eurosail   (a, c, and d, requested in the Pre Action Protocol returned to the claimant solicitor/director on the 25th September 2019)       2. As per Civil Procedure Rule 16.5 (4) it is expected that the Claimant prove the allegation that the money is owed.
    • But only if you remortgage with a new creditor and not the original mortgagee
    • CC told me they don't have a copy of the claim because it got sent out and that's it, they do not have a copy on file. And that I was given claim particulars (text) and I don't need the claim form to submit a n244    Correct MCOL do not retain hard copy of the actual N1...just the text particulars of claim/Claim number/Amounts/Claimants details...there is nothing further on the N1 required. . The other 2 people also said I do not need the original claim form to submit n244    I would have to agree...as long as you have the particulars of claim text.....the date ...claim number.....the amounts and the claimants name....should suffice.   Andy
    • A claim, or as the claims company have advised me, a product information request was supposedly submitted to Barclays in May of this year.....to date I have not had any acknowledgement from Barclays and more worryingly when I have rung Barclays PPI helpline who were very helpful, been told they have no record of anything lodged in any format...Should I be concerned that the claims company have not actually submitted anything or is it normal to have no standard letter from the bank?

Hello there,

 

Yesterday I made a reservation for collection of a camera in store.

When I arrived at the store, lady at reception went to get the camera for me.

I paid for it and left the store.

 

When I got home, I realized that the box was already teared up,

which I have photos of,

and which is even more weird,

the camera was damaged.

 

This is obviously a product that has been used either as showcase in store or returned by a customer.

I can’t believe that they're selling used and damaged products as brand new, and trying to get away with it.

 

I sent them an email with my complaint and received a call today.

Lady on the phone was extremely rude,

and she told me that the product was probably returned by other customer,

and she said it like it's the most normal thing in the world to put that product back on the shelf and sell it as brand new.

 

I asked them to send me a brand new camera instead,

so I don't have to drive again for 2 hours and ask for a refund or new camera,

which they refused,

saying that they can't do that because they're a big store and they have rules :!:

 

After a minute of talking,

she yelled at me in an extremely rude way "Goodbye" in the middle of conversation and hang up the phone.

They're not responding to my emails and are ignoring the matter.

Camera value is 79.99e.

 

I'm wondering what you guys think is the best way to approach this,

it's not just about the camera,

or driving back again

- it's about them getting away with doing things like that just because they're a giant chain store,

and acting that way,

like I did something wrong.

 

Worst customer experience I've ever had, by far - both in store and via the phone.

 

I'm just wondering what rights do I have because I would like to file a complaint or even go to the papers with the story,

 

I'll do whatever I can.

Well you've been invited to name them and you still haven't done so. I think that would be a good starting place.

 

After that, read our customer services guide and implement the advice there and then have further telephone calls. The conversation that you had was extremely useful but I expect that you don't have any evidence of it.

 

Tell us a bit more about the damage that you found on the camera. In any event, if it is damaged then under the Consumer Rights Act you are entitled to reject the camera within 30 days of having bought it on the basis that it is defective and you are entitled to insist on a refund.

 

Tell us who you are dealing with. Tell us about the damage. Write them a letter formally rejecting the camera under the Consumer Rights Act on the basis that it is defective.

Sorry about not naming them, I guess I thought that since this is a sub-forum called PcWorld, it would be obvious. Store is in Carrickmines, PcWorld.

I am aware that I can get a refund, I know I'm getting one. But just getting a refund is not what I'm after. That means they're getting away with it.

 

And not even to mention how rude that lady on the phone was.

 

About the damage, camera has deep scratches on its plastic on four different places, plus other minor signs of usage. It looks like it was used for at least one year.

 

I'll read the guide, thanks again.

About the damage, camera has deep scratches on its plastic on four different places, plus other minor signs of usage. It looks like it was used for at least one year.

 

Many digital cameras keep a count of how many times pictures were snapped. Have a read of the manual or have a search of the internet for which menu option you need to select.

Unfortunately you will have to return it to the store at some point

 

I would be making it clear in your letter to the CEO that this item is clearly second hand and therefore you are entitled to recalim your reasonable expenses to return the item such as petrol money, bus fare/train fare.

 

If you calculate what the cost of public transport would be then they are more likely to agree even if you do drive there.

Just an update on this,

after listening to your advice I sent an email to CEO.

 

Next morning I received four emails with genuine apologies and promise that they will greatly improve customer service provided in Carrickmines, which to be honest, was my intention.

 

Not the camera, or the value.

 

They are also delivering a replacement camera to my address.

 

Thanks for the advice guys, and I'm happy to see that tables have turned. :)
