On sunday it becomes illegal for companies to chage a fee for processing credit and debit cards.

 

Now this is no interest to the private parking forum becasue quite a few companies such as Euro Parking like to add an imaginary £1.50-2.00 unicorn food fee to their bills. The dodgy DCAlink3.gif's do the same.

 

Now, if they are claiming that you knew about these add ons because they were in the contract that will void the entire contract

 

If you are wanting to pay them because you somehow believe that they must be right otherwise they wouldnt write that in their letters then question yourself why a company would stoop so low as to chisel you for a couple of quid when you owe a hundred and risk it all?

 

look at the letters carefully adn if yours has a demand for a payemnt processing fee or adminlink3.gif fee for cards etc then tell us who so we can compile a checklist and help others to beat them with their own stick. I reckon a couple of hundred thousand complaints might fet the authorities doing something about this rotten business

Agree EB time the whole Private Parking Scramery was taken down, maybe this little change will be the stone from the slingshot that will fell the Goliath.

With restaurants and even airlines they are offering you a service, this lot are claiming the money is an amount due for a breach of contract or as a contractual sum. The VCS fight with HMRC rules out the legality of adding a service charge as they are not offering a "service".

 

Or they'll go the Just Eat route and rename it to a "Service Charge" that gets applied to all payments, even cash :)

still means they have to pay to replace all of their signs and then that leads them into the world of what is an "unconscionable amount"?

Indeed, but Just Eat are providing you with a service. Parking companies are/do not. If they try calling it a "Service Charge", HRMC are going to be after them like a dog with a bone! :lol:

They might certainly try it, but hopefully a court would slap them down as it probably would be contrary to the signage that they are too lazy to update.

the main thrust of the Beavis decision was that all of these costs would be bundles into the flat £80 so no need to quantify the coats or losses. Now, if they want to charge you for doing their paperwork that means that the actual charge becomes just a penalty and that would tip the balance into the "unconscionable". We already see Gladstone add unicorn food tax to all of their spurious claims because they get away with it most of the time. The more peopel tell them to eff off the better, they will have to start doing their jobs properly and find someone to write their signs ect for them as the advice they get so far is pants
